resolution passed by the Dunedin City Council on the twenty-
first day of October, one thousand nine hundred and forty,
viz.

"That the Dunedin City Council, being the local
authority having control of the streets in the City of
Dunedin, by resolution declares that the provisions
of section one hundred and twenty-eight of the Public
Works Act, 1928, shall not apply to the undermentioned
portions of streets, viz.:-

"(a) The south-western side of portion of Tannadice
Street, abutting on Allotments 6-10, D.P.
83, Township of Normanby; and
"(b) The north-western side of portion of Dryden
Street, abutting on Allotment 6, D.P. 83,
Township of Normanby";
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the south-
western side of the portion of Tannadice Street and the north-
western side of the portion of Dryden Street (described
in the Schedule hereto) within a distance of thirty-three feet
from the centre-lines of the said portions of streets.

SCHEDULE.
THE south-western side of all that portion of street, situated
in the Otago Land District, City of Dunedin, known as
Tannadice Street, fronting Lots 6, 7, 8, 9, and 10, D.P. 83,
Township of Normanby.
Also the north-western side of all that portion of street,
situated in the said land district and city, known as Dryden
Street, fronting Lot 6, D.P. 83, Township of Normanby.
As the same are more particularly delineated on the plan
marked P.W.D. 109345, deposited in the office of the Minister
of Public Works at Wellington, and thereon edged red.

The North-eastern Side of Portion of Eglinton Road, in the
City of Dunedin, exempted from the Provisions of Section 128
of the Public Works Act, 1928, subject to a Condition as to
the Building-line.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 4th day of
December, 1940.
Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of every other power in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the Dunedin City Council on the ninth
day of September, one thousand nine hundred and forty,
viz.:-

"That the Dunedin City Council, being the local
authority having control of the streets in the City of
Dunedin, by resolution declares that the provisions of
section one hundred and twenty-eight of the Public
Works Act, 1928, shall not apply to the north-eastern
side of portion of Eglinton Road abutting on part Lot
15, Deeds Plan 323, being part Section 13, Block VII,
and part Section 393R, Block VI, Town District";
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the north-
eastern side of the portion of Eglinton Road (described in
the Schedule hereto) within a distance of thirty-three feet
from the centre-line of the said portion of street.

SCHEDULE.
THE north-eastern side of all that portion of street situated
in the Otago Land District, City of Dunedin, known as
Eglinton Road, fronting part Lot 15, D.P. 323, being part
Section 13, Block VII, Town District, and part Lot 15,
Deeds Plan 323, Town District. As the same is more
particularly delineated on the plan marked P.W.D. 108952,
deposited in the office of the Minister of Public Works at
Wellington, and thereon edged red.

Street, fronting part Lot 11, Deeds Plan 110, and being
part Sections 2 and 3, Block VII, Anderson's Bay District.
As the same is more particularly delineated on the plan
marked P.W.D. 109448, deposited in the office of the Minister
of Public Works at Wellington, and thereon edged red.

Christchurch, exempted from the Provisions of Section 128
of the Public Works Act, 1928.

of December, 1940.

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the Christchurch City Council on the
fourteenth day of October, one thousand nine hundred and
forty, viz.:-

"The Christchurch City Council, having control of the
streets in the City of Christchurch, hereby declares that
the provisions of section one hundred and twenty-eight
of the Public Works Act, 1928, shall not apply to the
northern side of Fife Street adjoining the land in
Certificate of Title, Volume 242, folio 279";
such portion of street being described in the Schedule hereto.

SCHEDULE.
THE northern side of all that portion of street situated in the
Canterbury Land District, City of Christchurch, known as
Fife Street, fronting part of Town Reserve 125. As the same
is more particularly delineated on the plan marked P.W.D.
109346, deposited in the office of the Minister of Public
Works at Wellington, and thereon coloured red.
