Regulations under the Naval Defence Act, 1913, amended.
GALWAY, Governor-General.
ORDER IN COUNCIL.
At the Government House at Wellington, this 13th day of November, 1940.
Present :
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers and authorities conferred on him by section twenty-five of the Naval Defence Act, 1913, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, with the advice of the Executive Council, doth hereby amend and supplement the regulations referred to in the Schedule hereto as shown therein.
SCHEDULE.
Regulations for the Government and Payment of the New Zealand Naval Forces, 1939.
Article 260, paragraphs 3 (a) and (b): Cancel, and substitute :—
- The grant of a free passage for wife and family is subject to the following conditions :—
(a) The officer must be loaned for a period of not less than three years. Those loaned for a period of less than three years will not be granted free passages for their wives and families nor will this privilege apply if an officer is transferred from sea service to shore service.
(b) The right of the wife and family of an officer to a free passage will be forfeited—
(i) If they do not leave England within three months of the date of departure of the officer; or
(ii) If there is an intention that they shall not remain in New Zealand during his full period on loan.
The right to a return passage will also be forfeited—
(i) If the wife and family return to England before the term of the officer’s service expires; or
(ii) If they remain in New Zealand for six months after the officer has departed from the Dominion for reversion to the Royal Navy.
The Naval Board may authorize the forfeiture of passages to be waived in special circumstances provided that no additional expenditure is incurred as a charge to public funds.

SCHEDULE.
Regulations for the Government and Payment of the New Zealand Naval Forces, 1939.
Article 133, paragraphs 1 and (1) b: Cancel, and substitute :—
- Dependants Allowance.—When Marriage Allowance is not drawn an allowance of £1 per week, or 3s. per diem for broken periods, shall be payable as from 4th September, 1939, to ratings in respect of a dependant requiring support, subject to the same conditions as are in force for payment of Marriage and Children’s Allowance, under the following provisions :—
(b) An allowance at the minimum rate may also be approved by the Naval Board in any special cases where Marriage Allowance is not already paid and where dependence is clearly established, subject to the above limitations as to private income.

Revoking the Declaration of Main Highways and declaring Public Highways to be Main Highways.

ORDER IN COUNCIL.
At the Government House at Wellington, this 13th day of November, 1940.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers and authorities vested in him by section three of the Main Highways Act, 1922, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that on and after the date of publication of this Order in Council in the Gazette, the portions of main highways described in the First Schedule hereto shall cease to be main highways, and doth further declare that the roads described in the Second Schedule hereto shall be main highways within the meaning and for the purposes of the Main Highways Act, 1922.
FIRST SCHEDULE.
HIGHWAY DISTRICT NO. 2.
Birkenhead—Maungaturoto.—All that main highway in the counties of Waitemata and Rodney, declared as the Birkenhead—Maungaturoto Main Highway, described in Order in Council dated 2nd October, 1940, and published in the Gazette on 10th October, 1940.
Hamilton — Te Kuiti.—All that main highway in the counties of Waipa and Otorohanga, declared as the Hamilton—Te Kuiti Main Highway, described in Order in Council dated 2nd October, 1940, and published in the Gazette on 10th October, 1940.
HIGHWAY DISTRICT NO. 3.
Paeroa—Whakatane.—All that main highway in the counties of Tauranga and Whakatane, declared as the Paeroa—Whakatane Main Highway, described in Order in Council dated 2nd October, 1940, and published in the Gazette on 10th October, 1940.
HIGHWAY DISTRICT NO. 10.
Masterton—Castlepoint via Tinui.—All that main highway in the counties of Masterton and Castlepoint, declared as the Masterton—Castlepoint via Tinui Main Highway, described in Order in Council dated 2nd October, 1940, and published in the Gazette on 10th October, 1940.
SECOND SCHEDULE.
HIGHWAY DISTRICT NO. 2.
Birkenhead—Maungaturoto.—All that road or portion of road in the counties of Waitemata and Rodney, commencing at the Birkenhead Borough northern boundary, and proceeding thence generally in a north-westerly direction, but excluding that portion in the Warkworth Town District, and terminating at the Rodney County north-western boundary near Topuni, being a distance of 56 miles 3 chains, more or less; as the same is more particularly delineated on plan P.W.D. 107355, deposited in the office of the Main Highways Board at Wellington, and thereon coloured blue.
Hamilton — Te Kuiti.—All that road or portion of road in the counties of Waipa and Otorohanga, commencing at the southern boundary of Hamilton Borough, and proceeding thence generally in a southerly and south-westerly direction, but excluding those portions in the Te Awamutu Borough and the Otorohanga Town District, and terminating at the Otorohanga County southern boundary, being a distance of 37 miles 33 chains, more or less; as the same is more particularly delineated on plan P.W.D. 107355, deposited in the office of the Main Highways Board at Wellington, and thereon coloured red.
HIGHWAY DISTRICT NO. 3.
Paeroa—Whakatane.—All that road or portion of road in the counties of Tauranga and Whakatane, commencing at the north-western boundary of the Tauranga County at the south-western corner of Section 3, Block I, Katikati North Survey District, and proceeding thence generally in a south-easterly direction via Katikati, Tauranga, Te Puke, and Matata, but excluding those portions in the boroughs of Tauranga and Te Puke and terminating at the south-western boundary of Whakatane Borough, being a distance of 88 miles 12 chains, more or less; as the same is more particularly delineated on plan P.W.D. 107314, deposited in the office of the Main Highways Board at Wellington, and thereon coloured red.
