following resolution passed by the Devonport Borough Council on the sixteenth day of October, one thousand nine hundred and forty, viz. :—

"That the Devonport Borough Council, being the local authority having control of the streets in the Borough of Devonport, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the eastern side of portion of Wynyard Street abutting on part Allotment 22, Section 2, Parish of Takapuna, comprised in C.T. 134/281";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the eastern side of the portion of Wynyard Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE eastern side of all that portion of street, situated in the North Auckland Land District, Borough of Devonport, known as Wynyard Street, fronting Lots 9 and 10 of a sub-division of Allotment 22 of Section 2, Parish of Takapuna, bounded as appears on D.P. 737. As the same is more particularly delineated on the plan marked P.W.D. 109289, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The Southern Side of Portion of Oxford Street, in the Borough of Richmond, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 20th day of November, 1940.

Present:

His Excellency THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anyway enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Richmond Borough Council, viz. :—

"That the Richmond Borough Council, being the local authority having control of the streets of the Borough of Richmond, by resolution passed this twenty-seventh day of August, one thousand nine hundred and forty, declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of the southern side of Oxford Street fronting the northern boundary of parts of Sections 27 and 11 of 26 Waimea East, Block VII, Waimea Survey District (Estate of H. O. Washbourne)";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Oxford Street (described in the Schedule hereto) within a distance of thirty-five feet from the centre-line of the said portion of street.

SCHEDULE.

THE southern side of all that portion of street, situated in the Nelson Land District, Borough of Richmond, known as Oxford Street, fronting parts of Sections 27 and 11 of 26, District of Waimea East. As the same is more particularly delineated on the plan marked P.W.D. 108794, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The North-eastern Side of Portion of Mont Le Grand Road, in the Borough of Mount Eden, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

"The Mount Eden Borough Council, being the local authority having control of the streets in the Borough of Mount Eden, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of the north-eastern side of Mont Le Grand Road adjoining the land comprised in Certificate of Title, Volume 588, folio 227, Auckland Registry, being part Allotments 104 and 105, Section 10, Suburbs of Auckland";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of Mont Le Grand Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE north-eastern side of all that portion of street, situated in the North Auckland Land District, Borough of Mount Eden, known as Mont Le Grand Road, fronting part Allotment 105, Section 10, Suburbs of Auckland. As the same is more particularly delineated on the plan marked P.W.D. 108655, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The Southern Side of Portion of Waikanae-Waimea Main Highway (Moana Road) in the County of Horowhenua exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this 20th day of November, 1940.

Present:

His Excellency THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anyway enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Horowhenua County Council, in so far as it affects the side and portion of road described in the Schedule hereto, viz. :-

"That the Horowhenua County Council, being the local authority having control of the roads in the County of Horowhenua, by resolution this ninth day of August, one thousand nine hundred and forty, declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Moana Road adjoining part Section 35, Ngarara West A, Block V, Kaitawa Survey District, containing 20 acres, being the whole of the land in Certificate of Title 276, folio 225";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Waikanae-Waimea Main Highway (Moana Road) (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.
