And whereas it is deemed expedient to make such alteration of the boundaries of the said Borough :
Now, therefore, in pursuance and exercise of the powers and authorities vested in him by the said Municipal Corporations Act, 1933, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby declare that as on and from the first day of April, one thousand nine hundred and forty-one, the area described in the Schedule hereto shall be excluded from the County of Waitaki and included in the Borough of Oamaru.

SCHEDULE.
AREA EXCLUDED FROM THE COUNTY OF WAITAKI AND INCLUDED IN THE BOROUGH OF OAMARU.
ALL that area in the Otago Land District containing by admeasurement 8 acres 3 roods 38-11 poles, more or less, being Section 1 of 26, Township of Casanova Extension No. 3, Sections 5 and 6, Township of Casanova Extension No. 2, part Allotment 2, Deeds Plan 75, 1869-5 links; towards the north-east by the said Plan 75, 1869-5 links; towards the right-of-way shown on the said Plan 75, 1869-5 links; towards the south-east by a railway reserve, 475-28 links; towards the south-west by Warwick Settlement, the crossing of Leith Street, Allotments 53 and 44, Deposit Plan 3347, the crossing of Dart Street, Allotment 43, said Plan 3347, and part of Section 9, Block I, Oamaru Survey District, 1887-25 links; and towards the north-west by the North Road, 475 links; be all the aforesaid linkages more or less.

Authorizing the Minister of Public Works to erect, construct, provide, and use Works, Appliances, and Conveniences in connection with the Utilization of Water-power from the Waikato River, situated in the Land District of Auckland, for the Generation, Storage, Transmission, Distribution, and Sale of Electrical Energy in Terms of Section 311 of the Public Works Act, 1928.

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers vested in him by section three hundred and eleven of the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Minister of Public Works to erect, construct, provide, and use such works, appliances, and conveniences as may be necessary in connection with the utilization of water-power from the Waikato River, in the Land District of Auckland, and in connection therewith to raise or lower the level of the said river, and to impound or divert or control the flow of water from same for the generation and storage of electrical energy and in connection with the transmission, use, supply, and sale of electrical energy when so generated; also to use electrical energy so generated in the construction, working, or maintenance of any public work or for the smelting, reduction, manufacture, or development of ores, metals, or other substances, also to construct tunnels under private land or aqueducts over the same, erect poles thereon, and carry wires over or along any such land without being bound to acquire the same, and with the right of way to and along all such works and erections; and also to supply and sell electrical energy and recover moneys due for the same.

Authorizing the Laying-off of a Street (Extension of Bellevue Crescent) in the Borough of New Lynn, of a Width less than 66 ft. but not less than 40 ft., subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 13th day of November, 1940.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers vested in him by the Municipal Corporations Act, 1933, the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the New Lynn Borough Council to permit the laying-off of the proposed street, described in the Schedule hereto, of a width less than sixty-six feet but not less than forty feet, subject to the condition that no building or part of a building shall at any time be erected on the land as shown edged green on the plan referred to in the said Schedule and fronting the said street within a distance of forty-eight feet from the centre-line of the said street.

THAT proposed street, in the North Auckland Land District, Borough of New Lynn, containing by admeasurement 7-38 perches, more or less, being portion of Allotment 258, Parish of Waikomiti. As the same is more particularly delineated on the plan marked P.W.D. 105212, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The North-eastern Side of Portion of Melrose Street, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 13th day of November, 1940.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the seventh day of October, one thousand nine hundred and forty, viz.:
“That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-eastern side of portion of Melrose Street abutting on Lot 3 and part Lot 7, Township of Melrose ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of Melrose Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

THE north-eastern side of all that portion of street, situated in the Otago Land District, City of Dunedin, known as Melrose Street, fronting Lot 3 and part Lot 7, D.P. 4, Township of Melrose.
