Altering and redefining the Boundaries of the Manuherikia Rabbit District.—(Notice No. Ag. 3639.)


GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this 14th day of February, 1939.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by section thirty-one of the Rabbit Nuisance Act, 1928, it is enacted that the Governor-General, at the request of the Board of any Rabbit District, may by Order in Council alter and redefine the boundaries of its district:

And whereas the district known as the Manuherikia Rabbit District has been constituted under and for the purposes of the said Act:

And whereas the Board of the said district has, pursuant to the said section thirty-one of the said Act, requested that the boundaries of its district be altered and redefined by including an additional area therein:

And whereas the consent of a majority of the persons in such additional area qualified to be enrolled on the ratepayers’ list for the said district has been given to the inclusion of such additional areas in the said district:

And whereas it is deemed expedient to alter and redefine the boundaries of the said district accordingly:

Now, therefore, in pursuance and exercise of the powers and authorities conferred upon him by the said Act, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby—

  1. Alter and redefine the boundaries of the said district so constituted as aforesaid;

  2. Declare that the boundaries of the said district shall be those set forth in the Schedule hereto; and, further,

  3. Declare that this Order in Council shall come into force on the day following publication hereof in the Gazette.


SCHEDULE.

ALL that area of land in the Land District of Otago, Dominion of New Zealand, commencing at a point where Jackson Creek joins the Clutha River; thence in a southerly direction along the western side of the Clutha River to a point opposite the junction of the Clutha and Manuherikia Rivers; thence in a north-easterly direction along the eastern side of the Manuherikia River to the Northern boundary of Run 220B; thence following an easterly direction along the northern boundary of Run 220B; thence in a southerly direction along the eastern boundaries of Runs 220B, 220H, and 220G; thence in an easterly direction along the southern boundaries of Runs 220F and 220E to the north-west corner of Section 4, Block XIII, Tiger Hill Survey District; thence following the western and southern boundaries of Section 4, Block XIII, Tiger Hill Survey District; thence in a southerly direction along the western boundary of Run 587; thence in a south-easterly direction along the northern boundary of Run 565; thence in a south-westerly direction along the south-eastern boundaries of Runs 565 and 566; thence in a westerly direction along the southern boundaries of Runs 566, 567, and 569; thence in a north-easterly direction along the western boundary of Run 569 to Trig J; thence in a westerly direction along the southern boundaries of Runs 569 and 569A and crossing a road to Run 570; thence following the eastern and northern boundaries of Run 570 and crossing the Clutha River to its western bank; thence following the western bank of the Clutha River in a southerly direction to the north-east corner of Run 500; thence in a westerly direction along the northern boundary of Run 500; thence in a northerly direction along the western boundary of Run 499 to the south-east corner of Run 425B; thence in a north-westerly direction along the western boundaries of Runs 425B and 249A; thence in an easterly direction along the northern boundary of Run 249A to the Fraser River; thence following in a northerly direction along the eastern bank of the Fraser River and the western boundary of Run 249; thence in an easterly direction along the northern boundary of Run 249, to the point of commencement. Containing by admeasurement an area of 229,739 acres, be the same a little more or less; being more particularly shown edged in red on a plan (No. 76/1/2) deposited in the Head Office of the Department of Agriculture, Wellington.

Authorizing Dargaville Borough Council to fix Water Charges according to Quantity used.


GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this 14th day of February, 1939.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers and authorities conferred on him by section eighty-five of the Municipal Corporations Act, 1933, and of all other powers and authorities enabling him in this behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby consent to the Dargaville Borough Council making and levying water rates and charges in respect both of the ordinary as well as of any extraordinary supply, according to the quantity of water consumed by any person receiving the same as measured by meter, at such rates or charges as may from time to time be fixed by any by-law of the Council in that behalf, or as may be agreed on with any such person.

IN pursuance and exercise of the powers and authorities conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken for the purposes of a public school.
