Validating Proceedings in connection with the Thames County
Council’s Loan of £2,400.

GALWAY, Governor-General.
ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 9th day
of June, 1939.

Present:
THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.

WHEREAS the Thames County Council proceeded
by way of Special Order to raise a loan of two
thousand four hundred pounds (£2,400) to be known as
“Matatoki Subdivision Drainage Loan, 1939” (hereinafter
called “the said loan”):
And whereas the proceedings in connection with the said
loan were irregular or defective in that the public notice
of the resolution to make the Special Order authorizing
the raising of the loan, although given four times, was not
given once in each of the four weeks immediately preceding
the day on which the meeting was held for the purpose
of confirming that resolution as required by subsection
(c) of section ninety-nine of the Counties Act, 1920:
And whereas it appears that the ratepayers of the district
have not been misled by such irregularity as aforesaid and
it is expedient to validate the same:
Now, therefore, His Excellency the Governor-General
of the Dominion of New Zealand, in pursuance and exercise
of the powers and authorities conferred on him by section
one hundred and twenty-two of the Local Bodies’ Loans
Act, 1926, and acting by and with the advice and consent
of the Executive Council of the said Dominion, doth hereby
order and declare that the proceedings in connection with
the said loan shall be valid to all intents and purposes as
though the said public notice had been correctly given,
and that the validity of the proceedings in connection with
the said loan, or of the security for the said loan, shall not be
called in question by reason only of the irregularity or defect
aforesaid.

Cancelling the Vesting of Parts of Reserves in the Lyttelton
Borough Council.

GALWAY, Governor-General.
ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 9th day
of June, 1939.

Present:
THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.

WHEREAS the lands described in the Schedule hereto
are parts of reserves vested in the Mayor, Councillors,
and Burgesses of the Borough of Lyttelton, upon trust, as
and for sites for public buildings for the use and benefit
of the inhabitants of the Borough of Lyttelton and upon
trust to use and occupy the same when and so long as the
same or any part thereof shall not be built upon for general
municipal purposes:
And whereas by virtue of section four of the Borough
of Lyttelton Corporation Enabling Act, 1929, the Borough
Council was authorized to exercise all or any of the powers
of leasing and other powers set out in sections one hundred
and fifty-two to one hundred and fifty-five, one hundred
and fifty-eight to one hundred and sixty, and one hundred
and sixty-two of the Municipal Corporations Act, 1920, in
respect of the said lands:
And whereas it is expedient that the vesting of the said
lands as hereinbefore referred to should be cancelled, and the
Lyttelton Borough Council has duly consented to such
cancellation:
Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
and in pursuance and exercise of the powers and authorities
conferred upon him by subsection one of section ten of the
Public Reserves, Domains, and National Parks Act, 1928,
doth hereby cancel the vesting in the Mayor, Councillors,
and Burgesses of the Borough of Lyttelton of the lands
described in the Schedule hereto.

SCHEDULE.
CANTERBURY LAND DISTRICT.
ALL that area containing by admeasurement 26·2 perches,
more or less, being parts of Reserves 35 and 36, situated
in the Borough of Lyttelton, and bounded as follows:
Towards the north-east by Reserve 1372, 355·98 links;
towards the south-east by St. David Street 45·76 links;
towards the south-west by other parts of Reserves 35 and
36, 248·99 links and 107·02 links; and towards the north-
west by Oxford Street 46·15 links. As the same is more
particularly delineated on the plan marked L. and S. 6/6/693A,
deposited in the Head Office, Department of Lands and
Survey, at Wellington, and thereon bordered red.

Vesting a Reserve in the Whakatane Borough Council.

GALWAY, Governor-General.
ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 9th day
of June, 1939.

Present:
THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.

WHEREAS the land described in the Schedule hereto
has been duly set apart as a reserve for recreation
purposes: And whereas, in the opinion of the Governor-
General, it is expedient to vest the said reserve in the Mayor,
Councillors, and Burgesses of the Borough of Whakatane:
Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
and in exercise of the powers and authorities conferred upon
him by section nine of the Public Reserves, Domains, and
National Parks Act, 1928, doth hereby declare that from
and after the day of the date hereof, the reserve described in
the Schedule hereto shall become vested in the Mayor,
Councillors, and Burgesses of the Borough of Whakatane,
in trust, for recreation purposes.

SCHEDULE.
AUCKLAND LAND DISTRICT.
ALL that area in Whakatane County, containing by ad-
measurement 1 rood 7 perches, more or less, situated in
Block II, Whakatane Survey District, being part of the
Recreation Reserve shown on the plan numbered 20477,
deposited in the office of the District Land Registrar at
Auckland, and being part of Allotment 245, Waimana Parish:
Bounded towards the north-west generally by Section 13,
Block II, Whakatane Survey District; to the south-east
generally by Bay View Road, 423·04 links; to the south-
west generally by Lot 17 on plan 20477 aforesaid, and a
right line being the production of the north-eastern bound-
ary of Lot 17 aforesaid. As the same is more particularly
delineated on the plan marked L. and S. 25/1004A, deposited
in the Head Office, Department of Lands and Survey, at
Wellington, and thereon bordered red.

and consent of the Executive Council of the said Dominion,
