Varying the Determinations in respect of the Wellington Harbour Board’s Loan of £291,900.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 9th day of June, 1939.

Present:

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.

WHEREAS by Order in Council made on the tenth day of May, one thousand nine hundred and thirty-nine, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Wellington Harbour Board of the sum of two hundred and ninety-one thousand nine hundred pounds (£291,900) by a loan to be known as “Wellington Harbour Board Redemption Loan, 1940” (hereinafter called “the said loan”):

And whereas the authority conferred by the said Order in Council has not yet been exercised and it is expedient to vary certain of the determinations aforesaid in respect of the said loan:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary certain of the determinations aforesaid in respect of the said loan by prescribing as follows:—

(1) In lieu of a term of ten (10) years as specified in clause one of the said Order in Council the term for which the said loan or any part thereof may be raised shall not exceed twenty-one (21) years.

(2) In lieu of a rate of interest not exceeding three pounds ten shillings (£3 10s.) per centum per annum as specified in clause two of the said Order in Council the rate of interest that may be paid in respect of the said loan or any part thereof shall be such as shall not produce to the lender or lenders a rate or rates exceeding four pounds five shillings (£4 5s.) per centum per annum.

Varying the Determinations in respect of Portion (£96,300) of the Auckland Transport Board’s Loan of £500,000.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 9th day of June, 1939.

Present:

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.

WHEREAS by Order in Council made on the twentieth day of July, one thousand nine hundred and thirty-eight, and subject to the determinations as to borrowing and payment therein set out, consent was given to the raising by the Auckland Transport Board (hereinafter called “the said local authority”) of the sum of five hundred thousand pounds (£500,000) by a loan to be known as “Transport Consolidated Redemption Loan, 1938” (hereinafter called “the said loan”):

And whereas it was prescribed by the said Order in Council that the term for which a portion thereof, viz., one hundred thousand pounds (£100,000) may be raised shall not exceed ten (10) years:

And whereas a portion, ninety-six thousand three hundred pounds (£96,300) (hereinafter called “the said sum”), of this amount of one hundred thousand pounds (£100,000) has not yet been raised:

And whereas it is expedient that the term in respect of the said sum shall be extended to fifteen (15) years:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations aforesaid in respect of the said sum by prescribing that in lieu of a term not exceeding ten (10) years the term for which the said sum may be raised shall not exceed fifteen (15) years, and in lieu of provision being made for payment to the sinking fund at a rate or rates not less than eight pounds ten shillings and sixpence (£8 10s. 6d.), payments to such sinking fund shall be made at a rate or rates per centum which shall be not less than five pounds four shillings (£5 4s.).

Varying the Determinations in respect of the Balance (£2,000) of the Lake County Council’s Loan of £4,500 by prescribing Repayment on the Instalment-repayment System.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 9th day of June 1939.

Present:

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.

WHEREAS by Order in Council made on the twenty-second day of June, one thousand nine hundred and thirty-eight, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising by the Lake County Council (hereinafter called “the said local authority”) of the sum of four thousand five hundred pounds (£4,500) by a loan to be known as “Bridging Loan, 1938” (hereinafter called “the said loan”):

And whereas the authority conferred by the said Order in Council has not yet been exercised to the extent of two thousand pounds (£2,000) and it is expedient to vary certain of the determinations aforesaid in respect of this amount (hereinafter called “the said sum”):

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations aforesaid in respect of the said sum by prescribing that in lieu of making provision for the repayment of the said sum by establishing a sinking fund in respect thereof, the said local authority may raise the said sum upon terms of making the same, together with interest thereon, repayable by equal aggregate annual or half-yearly instalments extending over the period of twenty-five (25) years.
