The Western Side of Portion of Federal Street, in the City of Auckland, exempted from the Provisions of Section 128 of the Public Works Act, 1928.

ORDER IN COUNCIL.
At the Government House at Wellington, this 7th day of December, 1939.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anyway enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Auckland City Council on the third day of August, one thousand nine hundred and thirty-nine, viz.:-
"The Auckland City Council, being the local authority having control of the streets in the City of Auckland, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Federal Street adjoining part Allotment 19, Section 22, City of Auckland, comprised in C/T. 361/161";
the portion of street affected by such resolution being more particularly described in the Schedule hereto.
SCHEDULE.
THE western side of all that portion of street, situated in the the North Auckland Land District, City of Auckland, known as Federal Street, fronting part Allotment 19, Section 22, City of Auckland. As the same is more particularly delineated on the plan marked P.W.D. 104314, deposited in the office of the Minister of Public Works, and thereon coloured red.

Revoking Order in Council of the 23rd April, 1937, licensing the Manukau County Council to Use and Occupy a Part of the Foreshore and Land below Low-water Mark at Clevedon, Wairoa River, as a Site for a Wharf.

At the Government Buildings at Wellington, this 29th day of November, 1939.

THE HON. W. NASH PRESIDING IN COUNCIL.
WHEREAS by Order in Council dated the twenty-third day of April, one thousand nine hundred and thirty-seven, and published in the Gazette of the twenty-ninth day of the same month, at page 1057, the Manukau County Council (hereinafter called "the Council") was licensed to occupy a part of the foreshore and land below low-water mark at Clevedon on the Wairoa River in order to maintain a wharf thereon:
And whereas the Council has applied to have the herein-before-recited Order in Council revoked and it is desirable to revoke the same:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the Harbours Act, 1923, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the hereinbefore-recited Order in Council of the twenty-third day of April, one thousand nine hundred and thirty-seven, as from the date hereof.

Conferring Jurisdiction on the Native Land Court.

PURSUANT to section eighty of the Native Purposes Act, 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby confer upon the Native Land Court jurisdiction to make orders under the said section in respect of the land described in the Schedule hereto.
SCHEDULE.
ALL that area in the Borough of Tauranga containing by admeasurement 32 perches, more or less, situated in Block X, Tauranga Survey District, being Allotment 202 of Section 1, Town of Tauranga. (Auckland plan S.O. 441B.)

PURSUANT to section four hundred and forty-two of the Native Land Act, 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby prohibit all alienation of the Native land described in the Schedule hereto other than alienation in favour of the Crown.

Appointing a Member of the Otago Harbour Board.
GALWAY, Governor-General.
WHEREAS it is provided by section thirty-seven of the Harbours Act, 1923, that in the case of the death of a member of a Harbour Board his office shall become vacant and such vacancy shall be deemed an extraordinary vacancy: And whereas it is provided by subsection two of section thirty-eight of the said Act that when an elective member other than a representative of a constituent district vacates his office on the Board through the operation of the said section thirty-seven the Governor-General may, by Warrant under his hand, appoint some qualified person in his place: And whereas Robert Duncan, an elective member of the Otago Harbour Board, being a representative of the combined district of the City of Dunedin and the Borough of St. Kilda, is deceased, and it is desirable to appoint a qualified person in his place :
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in exercise of the herein-before-recited power and authority, doth hereby appoint David Copland to be a member of the Otago Harbour Board as a representative of the combined district aforesaid in the place of Robert Duncan, deceased.
As witness the hand of His Excellency the Governor-General, this 5th day of December, 1939.
