line of the said portion of road.
SCHEDULE.
The south-eastern side of all that portion of road in the Nelson
Land District, Takaka Town District, fronting part Section
18, District of Takaka. As the same is more particularly
delineated on the plan marked P.W.D. 104018, deposited
in the office of the Minister of Public Works at Wellington,
and thereon coloured red.

The Southern Side of Portions of Pah Street, in the Borough of
Motueka, exempted from the Provisions of Section 128 of the
Public Works Act, 1928, subject to a Condition as to the
Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 7th day of
December, 1939.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting by
and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the Motueka Borough Council on the
twenty-fifth day of July, one thousand nine hundred and
thirty-nine, in so far as it affects the portions and side of
street described in the Schedule hereto, viz.:
"That the Motueka Borough Council, being the local
authority having control of the streets in the Borough
of Motueka, by resolution declares that section one
hundred and twenty-eight of the Public Works Act, 1928,
shall not apply to that portion of Pah Street abutting
part Lot 5, D.P. 1575, and Lot 8, D.P. 1575, being
Sections 161 and 162 (N.R.), Motueka Survey District ";
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the southern
side of the portions of Pah Street (described in the Schedule
hereto) within a distance of thirty-five feet from the centre-
line of the said street.
SCHEDULE.
The southern side of all those portions of street situated in the
Nelson Land District, Borough of Motueka, known as
Pah Street, fronting Lot 8 and part Lot 5, D.P. 1575, being
parts of Sections 161 and 162 (N.R.), District of Motueka.
As the same are more particularly delineated on the plan
marked P.W.D. 105247, deposited in the office of the Minister
of Public Works at Wellington, and thereon coloured red.

Portions of Bentley Street, in the Borough of Masterton,
exempted from the Provisions of Section 128 of the Public
Works Act, 1928, subject to a Condition as to the Building-line.

of section one hundred and twenty-eight of the Public
Works Act, 1928, shall not apply to those portions of
street known as Bentley Street, adjoining Lot 17, D.P. 49,
Lots 22 and 27, D.P. 38, and Lot 6, D.P. 1352, being
parts Section 58, Masterton Small Farm Settlement ";
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the portions
of Bentley Street (described in the Schedule hereto) within a
distance of thirty-three feet from the centre-line of the said
street.
SCHEDULE.
First, the northern side of all that portion of street, situated
in the Wellington Land District, Borough of Masterton, known
as Bentley Street, fronting Lot 17, D.P. 49, and Lots 22 and
27, D.P. 38, being parts Section 58, Masterton Small Farm
Settlement, and shown coloured red on plan P.W.D. 104490.
Secondly, the southern side of all that portion of the said
street, fronting Lot 6, D.P. 1352, being part Section 58,
Masterton Small Farm Settlement, and shown coloured red
on plan P.W.D. 105114.
As the same are more particularly delineated on the plans
marked as above mentioned and deposited in the office of the
Minister of Public Works at Wellington.

New Plymouth, exempted from the Provisions of Section 128
of the Public Works Act, 1928.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting by
and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the New Plymouth Borough Council
on the nineteenth day of June, one thousand nine hundred
and thirty-nine, in so far as it affects the portion and side
of street described in the Schedule hereto, viz.:
"That the New Plymouth Borough Council, being the
local authority having control of the street hereinafter
mentioned, hereby resolves and declares that the pro-
visions of section one hundred and twenty-eight,
subsection one, of the Public Works Act, 1928, shall
not apply to that portion of the western side of James
Lane to which Lot 11 and part Lot 12, deposited plan
1271, Storehouse Reserve, New Plymouth, have
frontages ";
subject to the condition that no shop or other building with
a public entrance to James Lane, and no show-windows
fronting James Lane displaying wares for sale, shall at any
time be erected or permitted to be used on the land fronting
the western side of the portion of James Lane (described in
the Schedule hereto) within a distance of thirty-three feet
from the centre-line of the said street.
SCHEDULE.
The western side of all that portion of street situated in the
Taranaki Land District, Borough of New Plymouth, known as
James Lane, fronting Lot 11 and part Lot 12, Storehouse
Reserve, Town of New Plymouth, as shown on D.P. 1271.
As the same is more particularly delineated on the plan
marked P.W.D. 104445, deposited in the office of the Minister
of Public Works at Wellington, and thereon coloured red.
