The Western Side of Portion of Grey Street in the Borough of Marton, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 7th day of December, 1939.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Marton Borough Council on the fourteenth day of June, one thousand nine hundred and thirty-nine, in so far as it affects the portion and side of the street described in the Schedule hereto, viz. :—

“ The Marton Borough Council, being the local authority having control of the streets in the Borough of Marton, hereby by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of the street known as Grey Street, adjoining Lots 89, 90, and part 91 on deposited plan number 14, part of Section 17, Rangitikei Agricultural Reserve, Town of Marton ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of Grey Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE western side of all that portion of street, situated in the Wellington Land District, Borough of Marton, known as Grey Street, fronting Lot 89, D.P. 14, being part Section 17, Rangitikei Agricultural Reserve. As the same is more particularly delineated on the plan marked P.W.D. 103859, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.

The Western Side of Portion of Fitzroy Street, in the City of Auckland, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government Buildings at Wellington, this 29th day of November, 1939.

THE HON. W. NASH PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Auckland City Council on the fourteenth day of September, one thousand nine hundred and thirty-nine, in so far as it affects the portion and side of street described in the Schedule hereto, viz. :—

“ The Auckland City Council, being the local authority having control of the streets in the City of Auckland, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Fitzroy Street, fronting Lot 2 of Allotment 32, Section 8, Suburbs of Auckland, comprised in Certificate of Title, Volume 721, folio 253 ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of Fitzroy Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE western side of all that portion of street, situated in the North Auckland Land District, City of Auckland, known as Fitzroy Street, fronting Lot 133 of a subdivision of Allotment 32, Section 8, Suburbs of Auckland. As the same is more particularly delineated on the plan marked P.W.D. 105306, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The South-eastern Side of Portion of Holly Road, in the City of Christchurch, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 7th day of December, 1939.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Christchurch City Council on the nineteenth day of December, one thousand nine hundred and thirty-eight, viz. :—

“ The Christchurch City Council, being the local authority having control of the streets in the City of Christchurch, hereby, by resolution, declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the portion of the south-east side of Holly Road adjoining Lots 27 and 28, D.P. 815 ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Holly Road (described in the Schedule hereto) within a distance of forty-eight feet from the centre-line of the said portion of street.

SCHEDULE.

THE south-eastern side of all that portion of street, situated in the Canterbury Land District, City of Christchurch, known as Holly Road, fronting Lots 27 and 28, D.P. 815, being part Rural Section 46. As the same is more particularly delineated on the plan marked P.W.D. 104357, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The South-eastern Side of Portion of a Road in the Takaka Town District, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 7th day of December, 1939.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Takaka County Council, viz. :—

“ The Takaka County Council, being the local authority having control of the roads of the Township of Takaka, by resolution passed this tenth day of October, one thousand nine hundred and thirty-nine, declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-eastern side of the road on the north-western side of part Section 18, Takaka District, Block X, Waitapu Survey District ” ;
