County, by resolution passed this eleventh day of July,
one thousand nine hundred and thirty-nine, declares that
the provisions of section one hundred and twenty-eight
of the Public Works Act, 1928, shall not apply to the
road fronting parts Section 29, Takaka District, Block X,
Waitapu Survey District, and as shown on the accom-
panying plans ”;

subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the north-
eastern side of the portions of East Road (described in the
Schedule hereto) within a distance of thirty-five feet from
the centre-line of the said portions of road.

SCHEDULE.

THE north-eastern side of all those portions of road, situated
in the Nelson Land District, County of Takaka, known as
East Road, fronting parts Section 29, Takaka District, Block
X, Waitapu Survey District. As the same are more
particularly delineated on the plan marked P.W.D. 104190,
deposited in the office of the Minister of Public Works at
Wellington, and thereon coloured red.

The Western Side of Portion of Cornwall Street, in the City of
Christchurch, exempted from the Provisions of Section 128 of
the Public Works Act, 1928, subject to a Condition as to the
Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 8th day of
November, 1939.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by
the Public Works Act, 1928, and of all other powers
in anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the Christchurch City Council on the
eleventh day of September, one thousand nine hundred and
thirty-nine (the portion of street affected by such resolution
being more particularly described in the Schedule hereto
and being coloured red on the plan mentioned therein),
viz. :—

“The Christchurch City Council, being the local
authority having control of the streets in the City of
Christchurch, by resolution declares that the provisions
of section one hundred and twenty-eight of the Public
Works Act, 1928, shall not apply to that street or
portion of street known as Cornwall Street adjoining
the land comprised in Certificate of Title 105, folio 88,
being part Lot 1, D.P. 9445, part R.S. 311 ”;

subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the western
side of the portion of Cornwall Street (described in the
Schedule hereto) within a distance of thirty-three feet from
the centre-line of the said street.

SCHEDULE.

THE western side of all that portion of street, situated in
the Canterbury Land District, City of Christchurch, known
as Cornwall Street, fronting part Lot 1, D.P. 9445, being
part Rural Section 311. As the same is more particularly
delineated on the plan marked P.W.D. 103657, deposited
in the office of the Minister of Public Works at Wellington,
and thereon coloured red.

The South-eastern Side of Portion of Beachville Terrace West,
in the City of Nelson, exempted from the Provisions of
Section 128 of the Public Works Act, 1928, subject to a
Condition as to the Building-line.

1928, shall not apply to the south-eastern side of Beach-
ville Terrace West passing through Section 1180 (as
shown on the plan annexed hereto and thereon coloured
red and marked A–B) ”;

subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the south-
eastern side of the portion of Beachville Terrace West
(described in the Schedule hereto) within a distance of thirty-
three feet from the centre-line of the said portion of street.

ville Terrace West, fronting part Section 1180, City of Nelson.
As the said portion of street is more particularly delineated
on the plan marked P.W.D. 104313, deposited in the office

Works Act, 1928, shall not apply to the south-western
side of portion of Logan Street abutting on Section 27,
Block XIX, Dunedin ”;

subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the south-
western side of the portion of Logan Street (described in the
Schedule hereto) within a distance of thirty-three feet from
the centre-line of the said portion of street.
