Constituting the Southern Hawke’s Bay Rabbit District.—

ORDER IN COUNCIL.
At the Government House at Wellington, this 8th day of November, 1939.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by section thirty of the Rabbit Nuisance Act, 1928, it is enacted that the Governor-General may, by Order in Council, on petition in that behalf signed by a majority of the persons qualified to be enrolled on the ratepayers list for any proposed district, constitute and declare any area of land of not less than one thousand acres a rabbit district under and for the purposes of Part II of the said Act: And whereas in pursuance of the provisions of the said section thirty of the said Act a petition has been received praying that the area of land described in the Schedule hereto be constituted and declared a rabbit district under and for the purposes of Part II of the said Act, and it is deemed expedient to give effect to the prayer of the petitioners accordingly:
Now, therefore, in pursuance and exercise of the powers and authorities conferred upon him by the said Act, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby—
(1) Constitute by the specific name of the “Southern Hawke’s Bay Rabbit District” and declare the area of land defined in the Schedule hereto to be a rabbit district under and for the purposes of Part II of the said Act;
(2) Declare that the basis on which the Board to be established for the said district shall first levy its general rate shall be on the basis of the acreage of the rateable property in the said district; and, further,
(3) Declare that this Order in Council shall come into force on the first day of April, one thousand nine hundred and forty.

SCHEDULE.
BOUNDARIES OF THE SOUTHERN HAWKE’S BAY RABBIT DISTRICT.
ALL that area in the Hawke’s Bay and Wellington Land Districts comprising the Weber and Dannevirke Counties, and parts of the Woodville, Patangata, and Pahiatua Counties as now constituted, and bounded as follows: Commencing at a point on the summit of the Ruahine Range, being the northernmost point of the Dannevirke County; thence proceeding generally in a south-easterly direction along the northern and eastern boundaries of the Dannevirke County as described in New Zealand Gazette 1926, page 126, to the north-eastern corner of Section 4, Block XV, Mangatoro Survey District; thence south-easterly along the south-western boundary of the Patangata County as described in New Zealand Gazette 1927, page 2929, to the north-eastern corner of Section 4, Block I, Tautane Survey District; thence along the north-eastern boundaries of Block 58, Tautane Crown Grant District, Lot 1, D.P. 117, Blocks 55, 30, 26, 21, 50, 26, and 49 of the said Tautane Crown Grant District, and Lots 5, 9, and 11, D.P. 1215, to the sea at Arataura; thence southerly and westerly along the sea-coast to the Waimata Stream; thence westerly along the southern boundaries of the Weber and Dannevirke Counties as described in New Zealand Gazette 1921, page 583, and New Zealand Gazette 1926, page 126, respectively, to and along the southern boundaries of Blocks XV, XVII, and XIII, Tahoraite Survey District, to the south-eastern corner of Section 5, Block IX, Woodville Survey District; thence along the southern boundary of the said Section 5 a distance of 791·3 links; thence through Sections 2, 4, and 1 (E.R.), Block II, Makuri Survey District, Pahiatua County, by right lines as delineated on plan marked L.S. 92/327, deposited in the office of the Department of Agriculture, Wellington, to the southern boundary of the aforesaid Section 5, Block IX, Woodville Survey District; thence westerly along the southern boundary of Block IX, Woodville Survey District, to the middle-line of the Manawatu River; thence down the middle of the Manawatu River to the north-western boundary of Block XIV, Woodville Survey District; thence northerly along the north-western boundaries of Blocks XIV, XVI, and XV, Woodville Survey District, to Trig. Station No. 60A (Whariti), on the summit of the Ruahine Range; thence along the summit of the Ruahine Range to the point of commencement.

Authorizing the Auckland Harbour Board to Reclaim Land and Construct a Boat-harbour at Okahu and Hobson Bays in Auckland Harbour.

ORDER IN COUNCIL.
At the Government House at Wellington, this 8th day of November, 1939.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS it is provided by the one hundred and seventy-ninth section of the Harbours Act, 1923 (hereinafter called “the said Act”), that where a Harbour Board is desirous of executing or constructing upon lands vested in such Board or upon lands of the Crown any harbour-works of such a nature that the same could, but for this section, only be carried out and executed under the authority of a special Act, the Board may apply to the Governor-General in Council for a special order, and, if the Governor-General in Council thinks fit, such order may be made and granted: And whereas the Auckland Harbour Board (hereinafter called “the Board”) is desirous of reclaiming from the sea certain land, and of constructing a boat-harbour in Okahu and Hobson Bays, in Auckland Harbour, and the said harbour-works are of such a nature as aforesaid, and the Board has applied to the Governor-General in Council for a special order authorizing the execution of the said harbour-works: And whereas all the conditions precedent to the granting of a special order prescribed by section one hundred and seventy-nine of the said Act have been duly complied with: And whereas it has been made to appear to the Governor-General in Council that the proposed works will not be or tend to the injury of navigation:
Now, therefore His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by section one hundred and seventy-nine of the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize and empower the Board to reclaim from the sea in Auckland Harbour all the lands shown coloured red on plan marked M.D. 7884, and deposited in the office of the Marine Department at Wellington, and to construct a boat-harbour in Okahu and Hobson Bays in Auckland Harbour; such reclamation and boat-harbour to be carried out and constructed in accordance with plan marked M.D. 7884, subject to the provisions of the said Act; and the said harbour-works shall be completed within the period of five years computed from the date of this Order in Council.

Revoking Order in Council authorizing the Auckland Harbour Board to Reclaim Land and Construct a Boat-harbour at Okahu Bay in Auckland Harbour.

At the Government House at Wellington, this 8th day of November, 1939.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by Order in Council dated the nineteenth day of July, one thousand nine hundred and thirty-nine, and published at page 2045 of the Gazette No. 56 of the twenty-seventh day of the same month, the Auckland Harbour Board was authorized and empowered to reclaim from the sea in Auckland Harbour all the lands shown coloured red on plan marked M.D. 7803, and deposited in the office of the Marine Department at Wellington, and to construct a boat-harbour in Okahu Bay, in Auckland Harbour, in accordance with the said plan marked M.D. 7803:
And whereas it is desirable that the hereinbefore-recited Order in Council be revoked:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the Order in Council of the nineteenth day of July, one thousand nine hundred and thirty-nine, authorizing the Auckland Harbour Board to reclaim land in Auckland Harbour and construct a boat-harbour in Okahu Bay in accordance with plan marked M.D. 7803, deposited in the office of the Marine Department at Wellington.
