(2) By adding to the list of allowances contained in that portion of the First Schedule to the said
regulations relating to the Second Division the following allowance :—

(3) By adding to the Second Schedule as Regulation 12 thereof the following :—
“12. In any case where, immediately prior to the classification of members of the Road Services Branch pursuant to the provisions of the First Schedule hereof, any member of the First Division or Second Division employed in such branch was in receipt of a rate of pay in excess of the rate thereafter payable to him in accordance with such classification, such member may, at the discretion of the General Manager, be paid an allowance at a rate not exceeding the difference between such previous rate of pay and the rate payable in pursuance of the aforesaid First Schedule.”

Authorizing the Wellington Harbour Board to reclaim Land
in Evans Bay, Wellington Harbour.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 17th day
of December, 1938.
Present:
THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.
WHEREAS it is provided by section one hundred and sixty-eight of the Harbours Act, 1923 (hereinafter called “the said Act”), that the Governor-General may from time to time, by Order in Council, authorize any local authority or Harbour Board to reclaim from the sea, areas not exceeding five acres in extent, in any case where he considers that the reclamation will not affect navigation and is for the benefit of the public :
And whereas the Wellington Harbour Board (hereinafter called “the Board”) is desirous of reclaiming from the sea certain land in Evans Bay, Wellington Harbour, and the said reclamation is of such a nature as aforesaid, and the Board has applied to the Governor-General in Council for an order authorizing the execution of the said harbour works :
And whereas it has been made to appear to the Governor-General in Council that the proposed work will not be or tend to the injury of navigation, and is for the benefit of the public:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize and empower the Board to reclaim from the sea in Evans Bay, Wellington Harbour, the area of land coloured red on plan marked M.D. 7805, and deposited in the office of the Marine Department at Wellington, such reclamation to be carried out and constructed in accordance with the said plan marked M.D. 7805.

Extending Time for holding General Election of Trustees for Pyramid Block Drainage District.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 17th day of December, 1938.

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers and authorities vested in him by section twenty-two of the Land Drainage Amendment Act, 1922, and of all other powers in anyway enabling him in this behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby extend the time for holding the general election of trustees for the Pyramid Block Drainage District; and doth hereby order and declare that in the aforesaid drainage district the said general election shall be held and take place on Tuesday, the twenty-fourth day of January, one thousand nine hundred and thirty-nine.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anyway enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken for the purposes of a public school.
SCHEDULE.
APPROXIMATE area of the piece of land permitted to be taken: 36 perches.
Being part eastern portion Allotment 125, Oruawharo Parish. Situated in Block XII, Otamatea Survey District (Auckland R.D.). (S.O. 29705.)
In the North Auckland Land District; as the same is more particularly delineated on the plan marked P.W.D. 101205, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

IN pursuance and exercise of the powers and authorities vested in him by section one hundred and thirty-nine of the Municipal Corporations Act, 1933, and of all other powers and authorities in anyway enabling him in this behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby declare that the boundaries of the Borough of Whangarei are hereby altered so as to include within the limits of the said borough the lands described in the Schedule hereto, being lands, in respect of which there are no electors, adjacent to the said borough.
