The Butter Marketing Regulations, 1937.—Defining an Area within which Butter shall be disposed of only on behalf of the Department.

PURSUANT to the Butter Marketing Regulations, 1937, made under the Primary Products Marketing Act, 1936, and the Agriculture (Emergency Powers) Act, 1934, the Minister of Marketing doth hereby define and prescribe that portion of the Auckland Marketing District lying within a radius of 15 miles of Maungakiekie Trig. Station (One Tree Hill) and all that part of the Borough of Papakura not included within such area added thereto, to be an area under clause 13, subclause (b), of the said Regulations within which butter disposed of by wholesale shall only be so disposed of by wholesale distributors on behalf of the Department.

Fixing the Prices for the Sale of Butter by way of Sale by Wholesale in New Zealand.

PURSUANT to the Primary Products Marketing Act, 1936, and the Butter Marketing Regulations 1937, notice is hereby given for public information that on and after the 1st day of December, 1938, all butter sold or intended for sale by way of sale by wholesale in New Zealand shall be so sold in accordance with the following provisions of this notice :

  1. In this notice terms defined by the Butter Marketing Regulations 1937 (hereinafter called “the said regulations,”) shall have the respective meanings assigned to them by the said regulations.

  2. The grades referred to in clause 3 of this notice shall as the case requires, mean—
    (a) Grades assigned at a grading-store ;
    (b) Grades assigned in a manufacturing dairy as prescribed by clause 27 of the said regulations ; or
    (c) Grades constructively assigned pursuant to subclause (4) of clause 27 of the said regulations.

  3. Subject to the provisions of this notice, the several prices at which butter prepared in one pound pats or smaller portions shall be sold by way of sale by wholesale in New Zealand shall be the following :
    (a) In the case of salted creamery butter the standard of quality of which is not lower than first grade, the price of sixteen pence and one halfpenny per pound.
    (b) In the case of creamery butter the standard of quality of which is second grade the price of sixteen pence and one farthing per pound :
    (c) In the case of whey butter the standard of quality of which is not lower than second grade, the price of fifteen pence and one halfpenny per pound.

  4. The price of butter sold in bulk by way of sale by wholesale in New Zealand, being butter of one of the kinds and standards of quality set out in clause 3 hereof, shall be one-eighth of a penny per pound less than the respective price prescribed for butter of that kind and standard of quality by the said clause 3 hereof.

  5. The price of unsalted creamery butter the standard of quality of which is not lower than first grade and which is sold whether in bulk or in pats by way of sale by wholesale as aforesaid shall be one halfpenny per pound more than the respective price prescribed for such butter by the foregoing provisions of this notice.

  6. Notwithstanding anything in the foregoing provisions of this notice, the price for any parcel of butter sold whether in bulk or in pats in a quantity of less than forty-eight pounds by way of sale by wholesale as aforesaid, being butter of one of the kinds and standards of quality set out in clause 3 hereof, may (at the option of the vendor) be the sum of sixpence per parcel more than the appropriate price prescribed for butter of that kind and standard of quality by the foregoing provisions of this notice and every such sum of sixpence shall be added to the respective rates of one halfpenny per pound or portion of a pound referred to in clauses 7 and 8 of this notice, for the purposes of those clauses.

  7. In the case of sales in New Zealand from a manufacturer to a wholesale distributor, the prices at which butter shall be so sold shall be one halfpenny per pound or portion of a pound less than the respective prices hereinbefore specified.

  8. Upon every statement delivered by the Department to a manufacturer under clause 34 of the said regulations the Department in respect of sales by wholesale by the manufacturer in New Zealand (except sales by the manufacturer to a wholesale distributor) shall allow to the manufacturer as an addition to the aggregate amount of such sales a sum at the rate of one halfpenny per pound or portion of a pound.

  9. Upon delivery of butter by a manufacturer to the Department pursuant to the said regulations the Department shall account as required by clause 25 of the said regulations for all butter so delivered at the prices fixed by this notice reduced by a sum at the rate of one halfpenny per pound or portion of a pound.

The Shops and Offices Act, 1921–22, and its Amendments.—Fixing the Closing-hours of Butchers’ Shops within the Borough of Stratford.

WHEREAS a requisition in writing has been forwarded to me from the occupiers of butchers’ shops within the Borough of Stratford pursuant to section 32 of the Shops and Offices Act, 1921–22 :

And whereas I am satisfied that the signatures to such requisition represent a majority of the occupiers of all the said shops within the said borough :

Now, therefore, in pursuance of the said section 32, I, Hubert Thomas Armstrong, Minister of Labour, do hereby direct that on and after the 19th day of December, 1938, all the said shops within the said borough shall be closed in the evening of working-days as follows : On Mondays, Tuesdays, Wednesdays, Fridays, and Saturdays at 5 p.m., with the following exceptions :
(1) Should the occupier of any butcher’s shop, pursuant to section 14 of the Shops and Offices Act, 1921–22, observe the statutory closing-day on Saturday, the hour of closing for such shop on Thursday shall be 5 p.m. ; and
(2) On the working-day immediately preceding Christmas Day and on the working-day immediately preceding New Year’s Day, the hour of closing shall be 8.30 p.m.

WHEREAS a requisition in writing has been forwarded to me from the occupiers of grocers’ shops within the Borough of Lawrence, pursuant to section 32 of the Shops and Offices Act, 1921–22 :

And whereas I am satisfied that the signatures to such requisition represent a majority of the occupiers of all the said shops within the said borough :

Now, therefore, in pursuance of the said section 32, I, Hubert Thomas Armstrong, Minister of Labour, do hereby direct that on and after the 19th day of December, 1938, all the said shops within the said borough shall be closed in the evening of working-days as follows : On Mondays, Tuesdays, Thursdays, and Fridays at 5.15 p.m., and on Saturdays at 8.30 p.m. Provided that should the occupier of any shop affected by this notice observe, pursuant to section 14 (2) of the Shops and Offices Act, 1921–22, Saturday as the statutory closing-day, then, and in such case, the closing-hour on Wednesday shall be 5.15 p.m., and the closing-hour on Friday shall be 8.30 p.m.
