exempted from the Provisions of Section 128 of the Public
Works Act, 1928.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 13th day
of July, 1938.

Present:

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting by
and with the advice and consent of the Executive Council of
the said Dominion, doth hereby approve of the following
resolution passed by the Auckland City Council on the ninth
day of June, one thousand nine hundred and thirty-
eight, viz. :

"The Auckland City Council, being the local authority
having control of the streets in the City of Auckland, by
resolution declares that the provisions of section one hundred
and twenty-eight of the Public Works Act, 1928, shall not
apply to that portion of Carlaw Park Avenue fronting Lot 2
on D.P. 22823, being Section 97 and portion of Section 96,
Suburbs of Auckland ";

such portion of street being described in the Schedule hereto.

SCHEDULE.

THE north-western side of all that portion of street, situated
in the North Auckland Land District, City of Auckland,
known as Carlaw Park Avenue, fronting Lot 2, D.P. 22823,
being Section 97 and part Section 96, Suburbs of Auckland.
As the same is more particularly delineated on the plan
marked P.W.D. 99869, deposited in the office of the Minister
of Public Works at Wellington, and thereon coloured red.

Domain Board appointed to have Control of the Waharoa
Domain.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 13th day of
July, 1938.

Present:

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by
section forty-four of the Public Reserves, Domains, and
National Parks Act, 1925, His Excellency the Governor-
General of the Dominion of New Zealand, acting by and
with the advice and consent of the Executive Council of
the said Dominion, doth hereby appoint

Robert William Burns,
Raymond Silas Harris,
Charles John Casey,
Daniel Robert Gunn, and
Reginald William Petch

to be the Waharoa Domain Board, having control of the
land described in the Schedule hereto ; and doth hereby
appoint Monday, the twenty-fifth day of July, one thousand
nine hundred and thirty-eight, at eight o’clock p.m., as the
time when, and the Waharoa Public Hall as the place where,
the first meeting of the Board shall be held.

Cancelling the Reservation over Reserves in City of Christchurch,
Canterbury Land District.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 13th day
of July, 1938.

Present:

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers and authorities
conferred upon him by subsection one (b) of section
seven of the Public Reserves, Domains, and National Parks
Act, 1928, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
doth hereby revoke the reservation for public purposes over
the lands described in the First Schedule hereto, and doth
hereby declare that the said lands, being vested in the body
corporate called the Mayor, Councillors, and Citizens of the
City of Christchurch, may be disposed of by the said body
corporate by way of sale by public auction or private contract
at such price and on such terms and conditions as the said
body corporate may determine, but so that the proceeds of
any such sale shall be used and applied in or towards recouping
the said body corporate for the moneys expended by it in
the purchase for recreation purposes of the land described in
the Second Schedule hereto.

FIRST SCHEDULE.

CANTERBURY LAND DISTRICT.

ALL that area containing by admeasurement 1 rood 11-6
perches, more or less, being Lots 12 and 13 on plan deposited
in the Land Registry Office at Christchurch as No. 7472,
and being part Rural Section 125, situated in the City of
Christchurch, and bounded as follows : Towards the north
by Lot 4, D.P. 10997, 145-3 links ; towards the east by Lot
14, D.P. 7472, and Lot 3, D.P. 8125, 221-85 links ; towards
the south by Lionel Street, 145-92 links ; and towards the
west by Lot 11, D.P. 7472, 221-5 links. As the same is more
particularly delineated on the plan marked L. and S. 1/975/16,
deposited in the Head Office, Department of Lands and
Survey, at Wellington, and thereon bordered red.

All that area containing by admeasurement 28-1 perches,
more or less, being Lot 5 on plan deposited in the Land
Registry Office at Christchurch as No. 7636, and being part
of Rural Section 125, situated in the City of Christchurch,
and bounded as follows : Towards the north by Lot 6,
D.P. 7636, 79-5 links ; towards the east by Lots 3, 6, and 7,
D.P. 5832, 220 links ; towards the south by Woodham Road,
80-5 links ; and towards the west by Lot 4, D.P. 7636,
220 links. As the same is more particularly delineated on the
plan marked L. and S. 1/975/1e, deposited in the Head Office,
Department of Lands and Survey, at Wellington, and thereon
bordered red.

SECOND SCHEDULE.

CANTERBURY LAND DISTRICT.

All that area containing by admeasurement 12 acres 0 roods
1-5 perches, more or less, being Lots 7 to 21 inclusive, and
Lot 69, D.P. 9195, being part Rural Section 161, situated
in the City of Christchurch, and being part of the land
comprised in Certificate of Title, Volume 217, folio 295.
As the same is more particularly delineated on the plan marked
L. and S. 1/975/1c, deposited in the Head Office, Department
of Lands and Survey, at Wellington, and thereon bordered
green.
