Portions of Arran and Clyde Streets, in the County of Peninsula,
exempted from the Provisions of Section 128 of the Public
Works Act, 1928, subject to a Condition as to the Building-
line.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 13th day
of July, 1938.
Present:
THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in any-
wise enabling him in this behalf, His Excellency the Governor-
General of the Dominion of New Zealand, acting by and with
the advice and consent of the Executive Council of the said
Dominion, doth hereby approve of the following resolution
passed by the Peninsula County Council on the tenth day of
March, one thousand nine hundred and thirty-eight, viz. :
"That the Peninsula County Council, being the local
authority having control of the roads and streets in the
County of Peninsula, by resolution declares that the pro-
visions of section one hundred and twenty-eight of the
Public Works Act, 1928, shall not apply to the western
side of Arran Street from its junction with the Peninsula
Main Road to its junction with Clyde Street; to either
side of Clyde Street from its junction with C.R. 75R to its
junction with Arran Street or to the northern side of Clyde
Street from its junction with Arran Street to its junction
with Ocean View Terrace, all such roads being situated
in the Township of Lamlash shown on L.T.P. 190";
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting portion of
Arran Street or portions of Clyde Street (described in the
Schedule hereto), within a distance of thirty-three feet from
the centre-lines of the said portions of roads.
SCHEDULE.
THE western side of all that portion of road, situated in the
Otago Land District, County of Peninsula, known as Arran
Street, fronting Allotments l, 2, 3, 6, and 7, L.T.P. 190,
Township of Lamlash.
Also all that portion of road situated in the said land district
and county known as Clyde Street, adjoining or passing
through Allotments 4, 5, 7, 8, 9, and 10, L.T.P. 190, Township
of Lamlash.
Also the northern side of all that portion of the said Clyde
Street fronting Allotments 19, 32, and 41, L.T.P. 190,
Township of Lamlash.
As the same are more particularly delineated on the plan
marked P.W.D. 99311, deposited in the office of the Minister
of Public Works at Wellington, and thereon edged red.

Island, exempted from the Provisions of Section 128 of the
Public Works Act, 1928, subject to a Condition as to the
Building-line.

At the Government Buildings at Wellington, this 13th day
of July, 1938.

IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the Green Island Borough Council on
the fifth day of April, one thousand nine hundred and
thirty-eight, viz.:β
"That the Green Island Borough Council, being the
local authority having control of the streets in the Borough
of Green Island, by resolution declares that the provisions
of section one hundred and twenty-eight of the Public
Works Act, 1928, shall not apply to those portions of the
streets known as Muir and Loudon Streets adjoining
Allotments 23 and 25, Block III, Township of Green
Island";
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the southern
side of portion of Muir Street, or on the land fronting the
western side of portion of Loudon Street (described in the
Schedule hereto), within a distance of thirty-three feet from
the centre-lines of the said portions of streets.
SCHEDULE.
THE southern side of all that portion of street, situated in
the Otago Land District, Borough of Green Island, known as
Muir Street, fronting Allotments 23 and 25, Block III,
Township of Green Island.
Also the western side of all that portion of street in the
said land district and borough known as Loudon Street,
fronting Allotment 23, Block III, Township of Green Island.
As the same are more particularly delineated on the plan
marked P.W.D. 99488, deposited in the office of the Minister
of Public Works at Wellington, and thereon coloured red.
