passed by the Waitaki County Council on the twenty-sixth day of November, one thousand nine hundred and thirty-seven, viz. :

“ The Waitaki County Council, being the local authority having control of the roads in the Waitaki County, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to both sides of the road bounding and intersecting part Section 13, Block VIII, Otepopo Survey District ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the portion of road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.

SCHEDULE.

ALL that portion of road, situated in the Otago Land District, County of Waitaki, adjoining or passing through part Section 13, Block VIII, Otepopo Survey District. As the same is more particularly delineated on the plan marked P.W.D. 98043, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Portions of Oxford and Queen Streets, in the Borough of Richmond, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 26th day of January, 1938.

Present :

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Richmond Borough Council, viz. :

“ The Richmond Borough Council, being the local authority having control of the streets of the Borough of Richmond, by resolution passed this fourteenth day of December, one thousand nine hundred and thirty-seven, declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-western side of Queen Street on the north-eastern side of part Section 25, Waimea East, Block VII, Waimea Survey District, marked A-B, and to the north-eastern side of Oxford Street on the south-western side of the said section marked C-D and coloured red on plan ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of portion of Oxford Street or fronting the south-western side of the portion of Queen Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-lines of the said portions of streets.

SCHEDULE.

THE north-eastern side of all that portion of street, situated in the Nelson Land District, Borough of Richmond, known as Oxford Street, fronting part Section 25, Waimea East, Block VII, Waimea Survey District.

Also the south-western side of all that portion of street situated in the said land district and borough known as Queen Street, fronting part Section 25, Waimea East, Block VII, Waimea Survey District.

As the same are more particularly delineated on the plan marked P.W.D. 98129, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

“ The Auckland City Council, being the local authority having control of the streets in the City of Auckland, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Milton Street, adjoining part of Allotment 5, Section 8, Suburbs of Auckland, on D.P. 2426, and comprised in Certificate of Title, Volume 102, folio 227 ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Milton Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE south-eastern side of all that portion of street in the North Auckland Land District, City of Auckland, known as Milton Street, fronting part Allotment 5, Section 8, Suburbs of Auckland on D.P. 2426. As the same is more particularly delineated on the plan marked P.W.D. 98070, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

“ The Bruce County Council, being the local authority having control of the roads and streets in the County of Bruce, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of street known as District Road adjoining Allotment 1, Block I, Township of Stirling ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of the portion of road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.
