shall at any time be erected on the land fronting the eastern
side of portion of Jubilee Street, or on the land fronting the
southern side of portion of Hawthorn Avenue (described in
the Schedule hereto), within a distance of thirty-three feet
from the centre-lines of the said portions of streets.

SCHEDULE.
THE eastern side of all that portion of street, situated in the
Otago Land District, City of Dunedin, known as Jubilee
Street, fronting part Section 79, Block VI, Town District.
Also the southern side of all that portion of street in the said
land district and city known as Hawthorn Avenue, fronting
part Section 79, Block VI, Town District.
As the same are more particularly delineated on the plan
marked P.W.D. 99308, deposited in the office of the Minister
of Public Works at Wellington, and thereon edged red.

the City of Dunedin, exempted from the Provisions of Section
128 of the Public Works Act, 1928, subject to a Condition as
to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 22nd day of
June, 1938.
Present :
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in any-
wise enabling him in this behalf, His Excellency the Governor-
General of the Dominion of New Zealand, acting by and with
the advice and consent of the Executive Council of the said
Dominion, doth hereby approve of the following resolution
passed by the Dunedin City Council on the seven-
teenth day of January, one thousand nine hundred and
thirty-eight, viz. :—
“ That the Dunedin City Council, being the local autho-
rity having control of the streets in the City of Dunedin,
by resolution declares that the provisions of section one hundred
and twenty-eight of the Public Works Act, 1928,
shall not apply to the undermentioned portions of streets,
viz. :—
(a) The north-western side of portion of Falkirk Street
abutting on Allotments 22 and 24, Township of
Gladstone ;
(b) The southern and western sides generally of portion
of Gladstone Road abutting on Allotments 22,
23, and 32, Township of Gladstone ; and
(c) The south-eastern side of portion of Fortune Street
abutting on Allotments 31 and 32, Township of
Gladstone ” ;
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the north-
western side of portion of Falkirk Street, or the western side
generally of portion of Gladstone Road, or the south-eastern
side of portion of Fortune Street (described in the Schedule
hereto), within a distance of thirty-three feet from the centre-
lines of the said portions of streets.

Township of Gladstone.
Also the western side generally of all that portion of street

stone Road, fronting Allotments 22, 23, and 32, L.T.P., 608,
Township of Gladstone.
Also the south-eastern side of all that portion of street
situated in the said land district and city known as Fortune
Street, fronting Allotments 31 and 32, L.T.P. 608, Township
of Gladstone.
As the same are more particularly delineated on the plan
marked P.W.D. 99131, deposited in the office of the Minister
of Public Works at Wellington, and thereon coloured red.

also part Section 7, Block VI, Town District ; and
(b) The south-western side of portion of Leckhampton
Court abutting on Allotment 6, L.T.P. 169,
Township of Caversham Rise, being also part
Section 7, Block VI, Town District ” ;
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the north-
western side of portion of Dacre Court or the south-western side
of portion of Leckhampton Court (described in the Schedule
hereto), within a distance of thirty-three feet from the centre-
lines of the said portions of streets.
