Portions of Cubbabballa and Robert Streets, in the Borough of
Marton, exempted from the Provisions of Section 128 of the
Public Works Act, 1928, subject to a Condition as to the
Building-line.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 10th day
of June, 1938.
Present:
THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in any-
wise enabling him in this behalf, His Excellency the Governor-
General of the Dominion of New Zealand, acting by and with
the advice and consent of the Executive Council of the said
Dominion, doth hereby approve of the following resolution
passed by the Marton Borough Council on the fourteenth day
of March, one thousand nine hundred and thirty-eight, viz. :
“The Marton Borough Council, being the local authority
having control of the streets in the Borough of Marton,
hereby declares that the provisions of section one hundred
and twenty-eight of the Public Works Act, 1928, shall not
apply to those portions of Cubbabballa and Robert Streets,
fronting Lots 66, 67, 68, and 70, and coloured blue on the
plan submitted ”;
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the northern
side of the portion of Cubbabballa Street, or fronting the
eastern side of the portion of Robert Street (described in the
Schedule hereto), within a distance of thirty-three feet from
the centre-lines of the said portions of streets.
SCHEDULE.
The northern side of all that portion of street, situated in
the Wellington Land District, Borough of Marton, known as
Cubbabballa Street, fronting Lots 66, 67, and 68, Deeds
Plan 480.
Also the eastern side of all that portion of street, situated
in the said land district and borough, known as Robert Street,
fronting Lots 68 and 70, Deeds Plan 480.
As the same are more particularly delineated on the plan
marked P.W.D. 98840, deposited in the office of the Minister
of Public Works at Wellington, and thereon coloured blue.

Portions of Hadfield Road, in the County of Horowhenua,
exempted from the Provisions of Section 128 of the Public
Works Act, 1928, subject to a Condition as to the Building-
line.

At the Government Buildings at Wellington, this 10th day
of June, 1938.

Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the Horowhenua County Council on the
eighth day of April, one thousand nine hundred and thirty-
eight, the portions of road affected by such resolution being
more particularly described in the Schedule hereto :—
“The Horowhenua County Council, being the local
authority having control of Hadfield Road, by resolution
declares that the provisions of section one hundred and
twenty-eight of the Public Works Act, 1928, shall not apply
to the northern part of Hadfield Road adjacent to C.T.
236/144 ”;
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the portions
of Hadfield Road (described in the Schedule hereto) within
a distance of thirty-three feet from the centre-line of the said
portions of road.
SCHEDULE.
All those portions of Hadfield Road, situated in the Wellington Land District, County of Horowhenua, comprising those
portions of the north-eastern side and that portion of the
north-western side of the said road fronting Lot 1, D.P.
3246, being part Ngawhakangutu No. 1 South Block, Block
VI, Kaitawa Survey District. As the same are more particularly delineated on the plan marked P.W.D. 99272,
deposited in the office of the Minister of Public Works at
Wellington, and thereon coloured red.

Setting apart Unalienated Crown Land for Purposes of Part III
(State Coal-mines) of the Coal-mines Act, 1925.
GALWAY, Governor-General.
IN pursuance and exercise of the powers and authorities
conferred upon me by subsection one of section one
hundred and sixty-seven of the Coal-mines Act, 1925, and
of all other powers and authorities enabling me in this behalf,
I, George Vere Arundell, Viscount Galway, Governor-General
of the Dominion of New Zealand, do hereby declare that the
unalienated Crown land described in the Schedule hereto
is hereby set apart for the purposes of Part III of the said Act,
and do hereby further declare that this notice shall take
effect as from the date of the gazetting hereof.

Revoking in Part a Warrant setting apart Crown Land under
Section 20 of the Land Laws Amendment Act, 1912.
GALWAY, Governor-General.
IN pursuance and exercise of the powers and authorities
conferred upon me by section three of the Land Act,
1924, I, George Vere Arundell, Viscount Galway, Governor-
General of the Dominion of New Zealand, do hereby revoke in
so far as it relates to the land described in the Schedule hereto
the Warrant dated the seventeenth day of April, one thousand
nine hundred and twenty-three, and published in Gazette No.
37 of the twenty-sixth day of April, one thousand nine
hundred and twenty-three, page 1194, setting apart the said
land for disposal under section twenty of the Land Laws
Amendment Act, 1912.
SCHEDULE.
NORTH AUCKLAND LAND DISTRICT.
Sections 13 and 17, Parish of Mata: Area, 114 acres 1 rood
3 perches.
As witness the hand of His Excellency the Governor-
