SCHEDULE.
THE eastern side of all that portion of street, situated in the Wellington Land District, City of Wellington, known as Fortunatus Street, fronting Lots 224 and 226, D.P. 52, being part Section 15, Ohiro R.D., Block X, Port Nicholson Survey District. As the same is more particularly delineated on the plan marked P.W.D. 94652, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The Southern Side of Portion of Gilbert Street, in the Borough of New Plymouth, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 15th day of February, 1937.
Present:
THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the New Plymouth Borough Council on the sixteenth day of November, one thousand nine hundred and thirty-six, viz. :
“ That the New Plymouth Borough Council, being the local authority having control of the street hereinafter mentioned, hereby resolves and declares that the provisions of section one hundred and twenty-eight, subsection one, of the Public Works Act, 1928, shall not apply to that portion of the southern side of Gilbert Street to which Lots 1 and 2 of Subdivision 3, deposited plan 2535, being parts of Sections 1060 to 1063, New Plymouth, have frontages ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Gilbert Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE.
THE southern side of all that portion of street, situated in the Taranaki Land District, Borough of New Plymouth, known as Gilbert Street, fronting Lots 1 and 2 of Subdivision 3, D.P. 2535, being parts Sections 1060, 1061, 1062, and 1063, Town of New Plymouth. As the same is more particularly delineated on the plan marked P.W.D. 94690, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured blue.

“ The West Harbour Borough Council, being the local authority having control of the streets in the Borough of West Harbour, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to those portions of streets known as Manuka Road, Harbour Terrace, and Bay View Terrace, adjoining Allotments 33, 34, 42, and 43, Block I, Township of Ravensbourne ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of Manuka Road, or the south-eastern side of the portion of Harbour Terrace, or the north-western side of the portion of Bay View Terrace (described in the Schedule hereto), within a distance of thirty-three feet from the centre-lines of the said portions of streets.

THE north-eastern side of all that portion of street situated in the Otago Land District, Borough of West Harbour, known as Manuka Road, fronting Allotments 33 and 42, Block I, Township of Ravensbourne, being part Section 42, Upper Harbour West Survey District.
Also the south-eastern side of all that portion of street situated in the said land district and borough, known as Harbour Terrace, fronting Allotments 33 and 34, Block I, Township of Ravensbourne, being part Section 42, Upper Harbour West Survey District.
Also the north-western side of all that portion of street situated in the said land district and borough, known as Bay View Terrace, fronting Allotments 42 and 43, Block I, Township of Ravensbourne, being part Section 42, Upper Harbour West Survey District.
As the same are more particularly delineated on the plan marked P.W.D. 94805, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

As the same is more particularly delineated on the plan marked P.W.D. 94818, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
