Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations aforesaid in respect of the said loan by prescribing that the said local authority may in lieu of making provision for the repayment thereof over a period of twenty (20) years raise the said loan or any part thereof upon terms of making the same, together with interest thereon at a rate not exceeding three pounds ten shillings (£3 10s.) per centum per annum, repayable by equal aggregate annual or half-yearly instalments extending over a period of fifteen (15) years.

Order in Council varying the Determinations in respect of Two Portions of £5,000 each of the Waitemata Electric-power Board’s Loan of £35,000.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 18th day of February, 1937.

Present:

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.

WHEREAS by Order in Council made on the twenty-third day of December, one thousand nine hundred and thirty-six, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Waitemata Electric-power Board (hereinafter called “the said local authority”) of a loan of thirty-five thousand pounds (£35,000) being portion of the “Reticulation Loan, 1936,” of one hundred thousand pounds (£100,000):

And whereas the authority conferred by the said Order in Council has not yet been exercised, and it is expedient to vary the determinations in respect of two portions of five thousand pounds (£5,000) each (hereinafter called “the said sums”):

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary certain of the determinations aforesaid in respect of the said sums by prescribing as follows:—

(1) In lieu of the term of twenty-five (25) years specified in clause one of the said Order in Council the terms in respect of each of the said sums shall be fifteen (15) years.

(2) In lieu of repayment as specified in clause three of the said Order in Council each of the said sums shall be repaid as follows:—

(a) By thirty equal payments of one hundred and fifty pounds seventeen shillings and fivepence (£150 17s. 5d.), one of such payments in each case to be made at the end of every half-year commencing from the date on which the said respective sums were borrowed. Each such half-yearly payment shall be applied firstly in payment of interest computed at the rate of three pounds ten shillings (£3 10s.) per centum per annum on the amount of the principal for the time being outstanding in each respective case at the beginning of each such half-year and the balance of such half-yearly payment in reduction of such principal.

(b) By payments at the end of the fifteenth year from the date of the borrowing of each of the said sums of sums equal to the amount to which the principal has been reduced in each case in accordance with the preceding paragraph (a) hereof after payment of the aforesaid respective thirty (30) half-yearly payments.

Order in Council varying the Determinations in respect of the Central Hawke’s Bay Electric-power Board’s Loan of £10,000.

At the Government Buildings at Wellington, this 15th day of February, 1937.

WHEREAS by Order in Council made on the twenty-third day of December, one thousand nine hundred and thirty-six, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Central Hawke’s Bay Electric-power Board (hereinafter called “the said local authority”) of the sum of ten thousand pounds (£10,000) by a loan to be known as “Supplementary Loan, 1936” (hereinafter called “the said loan”):

And whereas the authority conferred by the said Order in Council has not yet been exercised:

And whereas it is expedient to vary the determinations in respect of the said loan:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary certain of the determinations aforesaid in respect of the said loan by prescribing as follows:—

(1) In lieu of the term of twenty-five (25) years specified in clause one of the said Order in Council the term shall be fifteen (15) years.

(2) In lieu of repayment as specified in clause three of the said Order in Council the said local authority shall make provision for the repayment of the said loan by annual redemption of debentures in the years and of the amounts as set out in the table hereunder:—

The Eastern Side of Portion of Fortunatus Street, in the City of Wellington, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 15th day of February, 1937.

Present:

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wellington City Council on the twelfth day of November, one thousand nine hundred and thirty-six, viz.:—

“The Wellington City Council, being the local authority having control of the streets in the City of Wellington, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that part of the eastern side of Fortunatus Street fronting Lots 224 and 226, D.P. 52”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the eastern side of the portion of Fortunatus Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
