The South-western Side of Portion of Sturges Avenue, in the Borough of Otahuhu, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 9th day of December, 1936.

Present:

His EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Otahuhu Borough Council on the fourteenth day of September, one thousand nine hundred and thirty-six, the portion of street affected by such resolution being more particularly described in the Schedule hereto, viz. :

"That the Otahuhu Borough Council, being the local authority having control of the streets in the Borough of Otahuhu, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of the street known as Sturges Avenue adjoining the land comprised in a plan deposited in the Land Registry Office at Auckland under number 26366 ";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of the portion of Sturges Avenue (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE south-western side of all that portion of street, situated in the North Auckland Land District, Borough of Otahuhu, known as Sturges Avenue, fronting Lots 2 and 3, D.P. 26366, being part Fairburn’s Grant, Manurewa Parish, Block VI, Otahuhu Survey District. As the same is more particularly delineated on the plan marked P.W.D. 94207, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The South-western Side of Portion of Argyle Street, the North-eastern Side of Portion of District Road, and the Western Side of Portion of Prospect Row, in the Borough of West Harbour, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

"The West Harbour Borough Council, being the local authority having control of the streets in the Borough of West Harbour, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to those portions of streets known as Argyle Street, District Road, and Prospect Row adjoining Allotments 1, 2, 3, 4, 5, 6, 7, 16, 17, 18, 19, and 20, Township of Roseneath ";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of the portion of Argyle Street, the north-eastern side of the portion of District Road, and the western side of the portion of Prospect Row (described in the Schedule hereto), within a distance of thirty-three feet from the centre-lines of the said portions of streets.

SCHEDULE.

THE south-western side of all that portion of street, situated in the Otago Land District, Borough of West Harbour, known as Argyle Street, fronting Allotment 16, Township of Roseneath.

Also the north-eastern side of all that portion of street in the said land district and borough, known as District Road, fronting Allotments 1, 3, 4, 5, 6, and 7, Township of Roseneath.

Also the western side of all that portion of street in the said land district and borough, known as Prospect Row, fronting Allotments 1, 2, 18, 19, and 20, Township of Roseneath.

As the same are more particularly delineated on the plan marked P.W.D. 94164, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.

The Eastern Side of Portion of Berwick Street, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the ninth day of November, one thousand nine hundred and thirty-six, viz. :

"That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the eastern side of portion of Berwick Street abutting on Lots 32 and 33, Township of Wakari ";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the eastern side of the portion of Berwick Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE eastern side of all that portion of street, situated in the Otago Land District, City of Dunedin, known as Berwick Street, fronting Lots 32 and 33, Township of Wakari. As the same is more particularly delineated on the plan marked P.W.D. 94231, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.
