the advice and consent of the Executive Council of the said Dominion, doth hereby authorize Cyril Frederick Turk, of Karamea (hereinafter referred to as “the licensee”), to lay, construct, put up, place, and use the electric lines described in the Schedule hereto on the following conditions.

CONDITIONS.

  1. PURPOSES OF LINES.

The said lines may be used for lighting, power, and heating purposes.

  1. LICENSE TO BE SUBJECT TO REGULATIONS.

The license hereby conferred is subject to compliance by the licensee with the Electrical Wiring Regulations, 1935, the Electrical Supply Regulations, 1935, and with all regulations made or to be made in amplification or amendment thereof or in substitution therefor.

The conditions directed to be implied in all licenses by the Electrical Supply Regulations, 1935, shall be incorporated herein and shall form part of this license except in so far as the same may be inconsistent with the provisions hereof.

  1. SYSTEM OF SUPPLY.

The system of supply shall be as described in paragraph (d) of clause 21-01 of the Electrical Supply Regulations, 1935.

  1. GENERATING VOLTAGE.

Electrical energy shall be generated and transmitted at a pressure of 110 volts direct current between terminals.

  1. DURATION OF LICENSE.

Unless sooner lawfully determined, this license shall continue in force until the 31st day of March, 1957, or until electrical energy is available from an Electric-power Board or other general public source, whichever is the earlier.

  1. CHARGES ON SALE.

Maximum Charges.

(1) The licensee shall not in respect of electrical energy distributed under the authority of this license make any charge exceeding those set out hereunder:—

(a) In the case of a supply for lighting purposes, a sum of one shilling per unit, reducible on payment within fourteen days of due date to ninepence per unit.

(b) In the case of a supply for motor-power, heating, cooking, or any purpose other than lighting purposes, a sum of sixpence per unit, reducible on payment within fourteen days of due date to fourpence halfpenny per unit.

Meter-rent.

(2) In addition to such charges as aforesaid, the licensee may make such charges for the rental of meters as may be authorized by regulations.

Minimum Charges.

(3) Notwithstanding the foregoing provisions, the licensee may make such minimum charge as may be authorized by regulations.

Intervals of Payments.

(4) Payment shall not be demanded from any consumer on dates at intervals apart of less than twenty-one days.

SCHEDULE.

LINES adapted for supply as prescribed in these presents for the transmission of electricity leading from the licensee’s generating station situated on road reserve opposite the licensee’s bakehouse in part Section 4, and proceeding thence in a north-westerly direction across the said road reserve to the licensee’s premises in part Section 4, thence in a south-westerly direction to a dwellinghouse occupied by Mrs. Kirby in another part of the said Section 4; all being situated in Block XIV, Oparara Survey District, in the Land District of Nelson, the said electric lines being more particularly delineated by means of white lines on plan P.W.D. 93640, deposited in the office of the Minister of Public Works at Wellington.

Authorizing Norah Schweigaard Grant, of Waipu, Farmer, to use Water for the Purpose of generating Electricity and to erect certain Electric Lines.

ORDER IN COUNCIL.

At the Government House at Wellington, this 9th day of December, 1936.

Present:

His Excellency the Governor-General in Council.

Pursuant to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby grant to Norah Schweigaard Grant, of Waipu, Farmer (hereinafter referred to as “the licensee”), a license subject to the conditions hereinafter set forth to obstruct, impound, or divert the waters of an unnamed stream situated in Section 208, Block I, Waipu Survey District, in the Land District of North Auckland, and to take and use therefrom for the purposes hereinafter set forth a stream of water not exceeding two cubic feet per second at any one time, and to lay, construct, put up, place, and use the electric lines hereinafter described.

CONDITIONS.

  1. IMPLIED CONDITIONS.

The conditions directed to be implied in all licenses by the Water-power Regulations, 1934, and the Electrical Supply Regulations, 1935, shall be incorporated in and shall form part of this license, except in so far as the same may be inconsistent with the provisions hereof.

  1. LICENSE SUBJECT TO REGULATIONS.

This license is issued under the Water-power Regulations, 1934, and is subject thereto and to the Electrical Supply Regulations, 1935, and the Electrical Wiring Regulations, 1935, and to any regulations made or to be made in amplification or amendment thereof or in substitution therefor.

  1. UTILIZATION OF WATER AND LOCATION OF HEADWORKS.

Water shall be used under this license solely for the purpose of generating electricity, and shall be taken from the stream at the point in Section 208, Block I, Waipu Survey District, indicated on the plan marked P.W.D. 93808, deposited in the office of the Minister of Public Works.

  1. GENERAL DESCRIPTION OF WORKS.

The licensee is hereby authorized, subject to the conditions hereof, to construct, maintain, and use the following works for the purposes of this license, the positions of the said works being indicated on the said plan P.W.D. 93808:—

(a) Headworks consisting of a dam and intake and water-race and pipe-lines leading to the water-wheel and power-house hereinafter referred to giving a static head of approximately seven feet.

(b) Tail-race leading from the said water-wheel to the said stream.

(c) A power-house situated on Section 208, Block I, Waipu Survey District, with all necessary equipment, including water-turbines, generators, transformers, lightning-arresters, switchboards, switches, exciters, and other appliances for generating electricity.

(d) Electric lines from the power-house aforesaid leading across Section 208 and a public road to the licensee’s premises on the said Section 208, all being situated in Block I, Waipu Survey District, in the Land District of North Auckland, and shown by means of dotted lines on the said plan.

  1. DURATION OF LICENSE.

Unless sooner determined, this license shall continue in force until the 31st day of March, 1957.

  1. SYSTEM OF SUPPLY.

The system of supply shall be as described in paragraph (d) of clause 21-01 of the Electrical Supply Regulations, 1935. The generating and transmission voltages shall be approximately 230 volts alternating current.

  1. RENTAL.

For the purpose of assessing the annual rental payable in respect of this license, the licensee may install a suitable maximum-demand indicator to the satisfaction of the Inspecting Engineer of the Public Works Department, and, failing such installation, the rental shall be assessed on the maximum generating capacity of the plant installed. The present plant is rated at one kilowatt, and falls within the classes described in paragraph (b) of clause (2) of Regulation 6 of the Water-power Regulations, 1934.
