Notice under the Shops and Offices Act, 1921–22, and its Amendments, fixing the Closing-hours of Chemists’ Shops within the Combined District of Dunedin.

———

W HEREAS a requisition in writing, signed by a majority of the occupiers of all the chemists’ shops within the Combined District of Dunedin, comprising the City of Dunedin, and the boroughs of St. Kilda, Port Chalmers, West Harbour, and Green Island, has been forwarded to me, desiring that all such shops within the said combined district, save and except the shop (hereinafter referred to as “the exempted shop”) established at 143 High Street, within the City of Dunedin, for the purpose only of the sale of medicines and surgical appliances that are urgently required, and known as the “Associated Chemists, Limited,” be closed as set out below, and that subsection (4) of section 35 of the Shops and Offices Act, 1921–22, should not apply to any shop within two miles and a half of the exempted shop while medicines and surgical appliances are obtainable from the exempted shop: On Mondays, Tuesdays, Wednesdays, and Thursdays at 6 p.m., on Fridays at 9.30 p.m., and on Sundays for the whole of the day, with the following exceptions—(1) Should the working-day that first precedes Christmas Eve, and should the working-day that first precedes New Year’s Eve, fall on Monday, Tuesday, Wednesday, or Thursday, then and in such case the closing-hour on such working-day shall be 9.30 p.m.; (2) on the working-day that first precedes Christmas Day, and on the working-day that first precedes New Year’s Day, the closing-hour shall be 11 p.m.; (3) on the working-day that first precedes Good Friday, the closing-hour shall be 9.30 p.m.:

And whereas I, Hubert Thomas Armstrong, Minister of Labour, am satisfied that the signatures to such requisition represent a majority of the occupiers of all the said shops within the said combined district, and that all the occupiers of the said shops within the said combined district affected by section 35 (1) of the said Act have been afforded an equal right to share at a reasonable cost in the profits of the business carried on by the exempted shop:

Now, therefore, in pursuance of sections 32 and 35 of the Shops and Offices Act, 1921–22, and in pursuance of section 15 of the Shops and Offices Amendment Act, 1927, I do hereby direct that on and after the 19th day of October, 1936, all the chemists’ shops within the Combined District of Dunedin, save and except the exempted shop, shall be closed accordingly.

The notice dated the 4th July, 1929, and published in the New Zealand Gazette of the 11th July, 1929, fixing the closing-hours of chemists’ shops in the Combined District of Dunedin shall be and is hereby cancelled as from the date of the coming into operation of this notice.

NOTES.—(1) Pursuant to section 21 (e) of the Shops and Offices Act, 1921–22, a chemist may keep his shop open (but only for the supply of medicines and surgical appliances) between the hours of 7 p.m. and 9 p.m. on the statutory closing-day.

(2) Pursuant to section 35 (4) of the Shops and Offices Act, 1921–22, a chemist in the combined district whose shop is more than two miles and a half from the exempted shop may supply medicines and surgical appliances that are urgently required on Sundays and on working-days outside the hours specified above: Provided that the shop is opened for such purpose only, and is closed immediately the sale is effected, and that the door of the shop is kept locked, except for the admission and exit of the customer.

Notice under the Shops and Offices Act, 1921–22, and its Amendments, fixing the Closing-hours of Tobacconists’ Shops within the Borough of Waitara.

W HEREAS a requisition in writing has been forwarded to me from the occupiers of tobacconists’ shops within the Borough of Waitara pursuant to section 32 of the Shops and Offices Act, 1921–22:

And whereas I, Hubert Thomas Armstrong, Minister of Labour, am satisfied that the signatures to such requisition represent a majority of the occupiers of all the said shops within the said borough:

Now, therefore, in pursuance of the said section 32, I do hereby direct that on and after the 19th day of October, 1936, all the said shops within the said borough shall be closed in the evening of working-days as follows: On Mondays, Tuesdays, and Fridays at 6 p.m.; on Wednesdays at 8 p.m.; and on Saturdays at 9.30 p.m., with the following exceptions—(1) On the working-day first preceding any of the special days mentioned in or coming within the meaning of section 26 of the Shops and Offices Act, 1921–22, there shall be no fixed closing-hour; and (2) should the occupier of any shop affected by this notice observe, pursuant to section 14 (2) of the Shops and Offices Act, 1921–22, Saturday as the statutory closing-day, then and in such case the closing-hour on Thursday shall be 6 p.m., and the closing-hour on Friday shall be 9.30 p.m.

Notice under the Shops and Offices Act, 1921–22, and its Amendments, prohibiting the Sale within the Borough of Waitara of certain Goods comprised in the Trade of a Tobacconist.

———

W HEREAS a petition in writing signed by a majority of the occupiers of all the tobacconists’ shops within the Borough of Waitara has been forwarded to me desiring that the sale of certain goods comprised in the trade of a tobacconist—namely, smoking requisites—be prohibited during such time as the said shops are required to be closed in pursuance of the Shops and Offices Act, 1921–22:

And whereas I, Hubert Thomas Armstrong, Minister of Labour, am satisfied that the sale of the said goods is comprised in the said trade within the said borough, and that the signatures to such petition represent a majority of the occupiers of all the said shops within the said borough:

Now, therefore, in pursuance of section 33 of the said Act, I do hereby direct that on and after the 19th day of October, 1936, the sale of the said goods within the said borough shall be and is hereby prohibited as follows: On Mondays, Tuesdays, and Thursdays after the hour of 6 p.m., on Wednesdays after the hour of 8 p.m., and on Fridays and Saturdays after the hour of 9.30 p.m., with the following exception: On the working-day first preceding any of the special days mentioned in or coming within the meaning of section 26 of the Shops and Offices Act, 1921–22, the sale of the said goods is not prohibited.

Date of Election by Fire-insurance Companies to fill Extraordinary Vacancy on the Oamaru Fire Board.

P URSUANT to the Fire Brigades Act, 1926, and the rules made thereunder, I, William Edward Parry, being the Minister charged with the administration of the said Act, do hereby appoint Monday, the 12th October, 1936, to be the date of holding the election of one member of the Oamaru Fire Board by the fire-insurance companies concerned, such election being held to fill the extraordinary vacancy caused by the resignation of Mr. S. B. Macdonald.
