In the matter of the Companies Act, 1933, and in the matter of FRED FORDE, LIMITED (and reduced).

N OTICE is hereby given that the order of the Supreme Court of New Zealand dated the 10th day of August, 1936, confirming the reduction of the capital of the company from £2,500 to £500, and the minute (approved by the Court) showing with respect to the capital of the company as altered the several particulars required by the Companies Act, 1933, were registered by the Registrar of Companies on the 19th day of August, 1936; and further take notice that the said minute is in the words and figures following:—

“The capital of Fred Forde, Limited (and reduced), henceforth is £500 divided into 500 ordinary shares of £1 each instead of £2,500 divided into 2,500 shares of £1 each. At the date of registration of this minute 228 only of such shares are deemed to be fully paid up.”

N OTICE is hereby given that at an extraordinary general meeting of members of the company held in the registered office, 203 British Chambers, High Street, Auckland, on Wednesday, 12th August, 1936, at 10 a.m., the following resolution was passed pursuant to subclause (b) of section 221 of the Companies Act, 1933:—

“That the company be wound up voluntarily, and that ROBERT ARTHUR SPINLEY, of Auckland, Public Accountant, be and the same is hereby appointed liquidator.”

In the matter of the Companies Act, 1933, and in the matter of the Building Societies Act, 1908, and in the matter of THE FARMERS’ CO-OPERATIVE PERMANENT BUILDING AND INVESTMENT SOCIETY OF NEW ZEALAND.

Before the Honourable Mr. Justice Ostler. Wednesday, the 19th day of August, 1936.

U PON reading the petition filed herein and the motion for an order in terms of the prayer thereof and the affidavits of Edward Percy Webster and Guy Macallan sworn and filed in support thereof, and upon hearing Mr. Ronald Henry Quilliam of counsel for the petitioner, this Court doth order that the voluntary winding up of the Farmers’ Co-operative Permanent Building and Investment Society of New Zealand be continued but subject to the supervision of this Court, and any of the proceedings under the said voluntary winding up may be adopted as the Court shall think fit: And it is ordered that the liquidator appointed in the voluntary winding up of the said society or other the liquidator for the time being do on the 9th day of November, 1936, and thenceforth every three months, file in the Registry of the Court a report in writing as to the position of, and the progress made with, the winding up of the said society, and with the realization of the assets thereof, and as to any other matters connected with the winding up as the Court may from time to time direct: And it is ordered that no bills of costs, charges, or expenses or special remuneration of any solicitor employed by the liquidator of the said society be paid out of the assets of the said society, unless such costs, charges, expenses, or remuneration shall have been taxed or allowed by the Registrar: And it is ordered that all such costs, charges, expenses, and remuneration be taxed and ascertained accordingly: And it is ordered that the costs and disbursements of the petitioner be paid out of the assets of the said society after the same have been taxed and allowed by the Registrar; and the creditors, contributories, and liquidator of the said society and all other persons interested are to be at liberty to apply generally as there may be occasion.

THE HAWKE’S BAY COUNTY COUNCIL.

NOTICE OF INTENTION TO TAKE LANDS FOR ROAD AND FOR A STOCK RESERVE.

In the matter of the Public Works Act, 1928, and the Counties Act, 1920.

N OTICE is hereby given that the Hawke’s Bay County Council proposes, under the provisions of the abovementioned Acts, to execute certain public works—namely, the construction of a new road and the acquisition of land for the purpose of paddocking driven cattle—and for the purpose of such public works the lands described in the First and Second Schedules hereto are required to be taken:

Notice is further given that a plan of the lands so required to be taken for the construction of a new road and for the purpose of paddocking driven cattle is deposited in the public offices of the Clerk to the said Council at Napier and is open for inspection by all persons during ordinary office hours: All persons affected by the execution of the said public works or by the taking of the said lands who have any wellfounded objections to the execution of the said public works or to the taking of the said lands must state their objections in writing and send the same on or before the 1st day of October, 1936, being a date not less than forty days from the first publication of this notice, to the County Council at the Council Chambers, Browning Street, Napier.

N OTICE is hereby given that the order of the Supreme Court of New Zealand dated the 17th day of August, 1936, confirming the reduction of the capital of the abovementioned company from £1,000,000 to £700,000, and the minute approved by the Court, showing with respect to the capital of the company, as altered, the several particulars required by the above statute, were registered with the Registrar of Companies on the 20th day of August, 1936; and take further notice that the said minute is in the words and figures following:—

“The capital of New Zealand Newspapers, Limited, henceforth is £700,000 divided into 840,000 shares of 16s. 8d. each instead of the original capital of £1,000,000 divided into 1,000,000 shares of £1 each. At the time of registration of this minute 597,500 of the said shares have been issued and each of the said 597,500 said shares have been and are deemed to be fully paid and the residue of the said shares—namely, 242,500—are unissued.”
