The Northern Side of Portion of College Street, and the Western Side of Portion of Queen Victoria Street, in the Borough of Motueka, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 26th day of August, 1936.

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Motueka Borough Council on the fourteenth day of January, one thousand nine hundred and thirty-six, viz. :

β€œ That the Motueka Borough Council, being the local authority having control of the streets within the Borough of Motueka, hereby declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of the northern half of College Street and the western half of Queen Victoria Street bounding Sections 189 and 190, Motueka Original District, Block III, Motueka Survey District ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of the portion of College Street, or the western side of the portion of Queen Victoria Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-lines of the said portions of streets.

SCHEDULE.

THE northern side of all that portion of street, situated in the Nelson Land District, Borough of Motueka, known as College Street, fronting Section 190, Motueka Original District, Block III, Motueka Survey District.

Also the western side of all that portion of street in the said land district and borough, known as Queen Victoria Street, fronting Sections 189 and 190, Motueka Original District, Block III, Motueka Survey District.

As the same are more particularly delineated on the plan marked P.W.D. 91368, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Notifying the proposed Exchange of Crown Land in the Auckland Land District for other Land.

GALWAY, Governor-General.

WHEREAS by section one hundred and sixty of the Land Act, 1924, it is enacted that it shall be lawful for the Governor-General, whenever he deems it expedient in the public interest, to grant in fee-simple any area of Crown land which is subject to the provisions of the Land Act, 1924, in exchange for the fee-simple of any other land, and on any such exchange to pay or receive any sum by way of equality of exchange:

And whereas in the opinion of the Governor-General it is expedient to exchange the Crown land described in the First Schedule hereto for the land described in the Second Schedule hereto, and the owner of the land described in the Second Schedule has agreed to such exchange:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in exercise of the aforesaid powers and authorities, doth hereby declare it is his intention to grant in fee-simple the area of Crown land described in the First Schedule hereto in exchange for the fee-simple of the land described in the Second Schedule.

FIRST SCHEDULE.
DESCRIPTION OF LAND AUTHORIZED TO BE EXCHANGED.

ALL that area in the Auckland Land District, Waitomo County, containing by admeasurement 35 acres 1 rood 30 perches, more or less, and being Section 24, Block XI, Orahiri Survey District. As the same is more particularly delineated on a plan marked L. and S. 36/743, deposited in the Head Office, Lands and Survey Department, Wellington, and thereon edged blue. (Auckland plan S.O. 27720.)

SECOND SCHEDULE.
DESCRIPTION OF LAND TO BE OBTAINED IN EXCHANGE THEREFOR.

ALL that area in the Auckland Land District, Waitomo County, containing by admeasurement 26 acres 1 rood 35 perches, more or less, being portion of the Piha No. 1B No. 1 Block, and being all the land on a plan numbered 25280, deposited in the office of the District Land Registrar at Auckland. As the same is more particularly delineated on a plan marked L. and S. 36/743A, deposited in the Head Office, Lands and Survey Department, Wellington, and thereon edged red.

As witness the hand of His Excellency the Governor-General, this 18th day of August, 1936.
