the “Railways Improvements and Additions to Open Lines” Vote of the Public Works Fund in respect of the cost of assets worn out, abandoned, destroyed, or obsolete in the service of the Working Railways Department.

  1. Interest on surplus moneys of the Working Railways Account invested in terms of section thirty-nine of the said Act shall be paid to the Working Railways Account as and when received by the Treasury.

  2. Any securities in which any of the balances of the Public Account may from time to time lawfully be invested pursuant to section thirty-nine of the Public Revenues Act, 1926, are hereby declared to be securities in which any moneys in the Working Railways Account may be invested in manner prescribed by section ninety-seven of the Public Revenues Act, 1926, pursuant to section thirty-nine of the Government Railways Act, 1926.

  3. This Order in Council shall be deemed to have come into operation on the first day of April, one thousand nine hundred and thirty-five, in substitution for the Order in Council made under the Government Railways Amendment Act, 1925, on the twenty-second day of February, one thousand nine hundred and twenty-six, which, together with all amendments thereto, shall be deemed to have been revoked as on and from the said first day of April, one thousand nine hundred and thirty-five.

Validating Proceedings in connection with Poll on Loan Proposal taken by Grey Electric-power Board.

GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this 12th day of December, 1935.

Present:

His Excellency the Governor-General in Council.

WHEREAS a poll of ratepayers was taken by the Grey Electric-power Board on the fourth day of December, one thousand nine hundred and thirty-five (hereinafter referred to as “the appointed day”), on a proposal to raise a special loan of sixteen thousand pounds under the Local Bodies’ Loans Act, 1926, for the purpose of purchasing and constructing electric works, as defined by the Electric-power Boards Act, 1925, comprising raising the Kaimata Dam level at the headworks and further reticulation:

And whereas the proceedings in connection with the said poll were irregular in that the poll was not closed at six o’clock in the afternoon of the appointed day, as required by section eighteen of the Local Elections and Polls Act, 1925, but was closed at seven o’clock in the afternoon of that day:

And whereas it is desirable to validate the irregularity aforesaid:

Now, therefore, in pursuance of the powers and authorities conferred upon him by section seventy-one of the Local Elections and Polls Act, 1925, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby order and declare that the proceedings in connection with the said poll shall be valid to all intents and purposes as though the poll had closed at six o’clock in the afternoon of the appointed day; and that the validity of the proceedings in connection with the said poll shall not be called in question by reason only of the irregularity aforesaid.

Vesting the Control of the Taihape Scenic Reserves in the Taihape Borough Council.

GALWAY, Governor-General.

IN pursuance and exercise of the powers and authorities conferred upon him by section thirteen of the Scenery Preservation Act, 1908 (hereinafter referred to as “the said Act”), His Excellency the Governor-General of the Dominion of New Zealand doth hereby vest the control of the Taihape Scenic Reserves (being lands reserved under the said Act) as described in the Schedule hereto in the Taihape Borough Council, subject to the conditions hereinafter contained, that is to say:—

  1. The period for which the control is hereby vested shall be five years from the date hereof, unless the reservation is previously altered or revoked under the said Act.

  2. The said Council shall prepare a report each year ending on the thirty-first day of March, together with a statement of receipts and expenditure in connection with the said reserves. Such report and statement shall be sent to the Minister charged with the administration of the said Act as soon as possible after the close of the year.

  3. The said Council shall control the said reserves in accordance with the provisions of the said Act and of the regulations made thereunder.

TAIHAPE SCENIC RESERVES.

All that area in the Wellington Land District, containing by admeasurement 164 acres 3 roods 8 perches, being part of Section 62, Block XIV, Ohinewairua Survey District. As the same is more particularly described in the Schedule to a Proclamation published in Gazette of the 21st day of February, 1918, page 554.

Section 63, Block XIV, Ohinewairua Survey District: Area, 1 acre 1 rood.

Section 64, Block XIV, Ohinewairua Survey District: Area, 40 acres 3 roods.

Section 79, Block XIV, Ohinewairua Survey District: Area, 1 acre 0 roods 20 perches.

Section 80, Block XIV, Ohinewairua Survey District: Area, 4 acres 0 roods 11 perches.

As witness the hand of His Excellency the Governor-General, this 9th day of December, 1935.

Declaring Te Mata Park, Havelock North, to be a Sanctuary under the Animals Protection and Game Act, 1921-22, Hawke’s Bay Acclimatization District.

GALWAY, Governor-General.

IN pursuance of the powers conferred upon me by section six of the Animals Protection and Game Act, 1921-22 (hereinafter referred to as “the said Act”), I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, do hereby notify and declare the area described in the Schedule hereto to be a sanctuary for the purposes of the said Act.

TE MATA PARK.

All that parcel of land in the Hawke’s Bay Land District, known as Te Mata Park, situated in Block IV, Kidnapper, and Block VIII, Te Mata, Survey Districts, containing by admeasurement 242 acres 0 roods 35 perches, more or less, and being Lots 4 and 5 on plan No. 4149, deposited in the office of the District Land Registrar at Napier, which said parcel of land is portion of Havelock Suburban Sections 44 and 45 and of Block 9, Te Mata Crown Grant District, and being all the land comprised in Certificate of Title, H.B., Volume 41, folio 249; as the same is delineated on the plan marked I.A. 1935/37/17, deposited in the Head Office, department of Internal Affairs, Wellington, and thereon bordered red.

As witness the hand of His Excellency the Governor-General, this 10th day of December, 1935.

PURSUANT to the authority conferred upon me by the three-hundred-and-first section of the Justices of the Peace Act, 1927, I, George Vere Arundell, Viscount Galway, the Governor-General of the Dominion of New Zealand, do hereby notify and declare that the persons whose names are set out in the Schedule hereto, being officers in the service of the Crown holding the offices stated opposite their names respectively in the said Schedule, are authorized to take and receive statutory declarations under the three-hundred-and-first section of the Justices of the Peace Act, 1927.
