Regulations under the Air Navigation Act, 1931.

AMENDMENTS No. 3.

ORDER IN COUNCIL.

At the Government House at Wellington, this 3rd day of December, 1935.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers and authority vested in him by the Air Navigation Act, 1931, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend in the manner and to the extent set forth in the Schedule hereto the Air Navigation Regulations, 1933, published in the New Zealand Gazette dated the first day of June, one thousand nine hundred and thirty-three, and declare that such amendments shall come into operation on the publication thereof in the Gazette.

  1. Section VI: Overhauls, repairs, &c.:

Paragraph 38, subparagraph (3), line 6—

For the words “an N.Z. Permanent Air Force aerodrome by N.Z.P.A.F. personnel” substitute “a Royal New Zealand Air Force aerodrome by R.N.Z.A.F. personnel.”

Schedule V.—Licensing of Personnel.

  1. Paragraph 8, subparagraph (h) (page 34):

Add at end: “A candidate suffering from daltonism may, however, be accepted as eligible for the issue of a license valid only for flight by day—that is to say, between sunrise and sunset.”

  1. Paragraph 25, subparagraph 2 (c), line 1 (page 39):

For the words “Air Regulations and Pilotage,” substitute “Air Regulations and Navigation.”

Regulations under the Government Railways Act, 1926.

GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this 3rd day of December, 1935.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS section thirty-six of the Government Railways Act, 1926 (hereinafter referred to as “the said Act”), is in the following terms: “There is hereby established within the Public Account a separate account to be called the Working Railways Account, which shall for all purposes be deemed to be the same account as that established by the same name under section three of the Government Railways Amendment Act, 1925”:

And whereas section thirty-seven of the said Act specifies (inter alia) the moneys which shall be paid out of the Consolidated Fund into the Working Railways Account, and section thirty-eight thereof specifies (inter alia) the moneys which shall be paid out of the Working Railways Account into the Consolidated Fund:

And whereas by section thirty-nine of the said Act it is provided that any moneys in the Working Railways Account which in the opinion of the Government Railways Board are not required for the purposes of that Account may be invested in manner prescribed by section ninety-one of the Public Revenues Act, 1910 (now section ninety-seven of the Public Revenues Act, 1926):

And whereas section forty of the said Act makes provision whereby the Governor-General may, from time to time, by Order in Council—

(a) Determine the rates of interest to be from time to time payable in terms of sections thirty-seven and thirty-eight of the said Act:

(e) Determine the amount and the times and the manner of payment of the sums by the said Act authorized to be paid from the Consolidated Fund into the Working Railways Account, or from that Account into the Consolidated Fund:

(f) Do any other thing necessary for the carrying out of the provisions of the said Act relative to the Working Railways Account:

And whereas it is necessary that the powers hereinbefore specified should be exercised:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred on him by the said section forty of the said Act, and of every other power and authority enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order as follows:—

  1. The rate of interest payable under paragraph (a) of subsection one of section thirty-eight of the said Act—that is to say, on the total amount of capital moneys deemed to be expended in respect of the railways—shall be four and one-quarter per centum per annum.

  2. (a) The rate of interest payable under paragraph (c) of subsection one of section thirty-eight of the said Act—that is to say, in respect of moneys advanced by way of loan from the Consolidated Fund—shall be four per centum per annum.

(b) Interest payable under paragraph (c) of subsection one of section thirty-eight of the said Act shall be computed from day to day on the amount of advances outstanding, and shall be payable quarterly on the last day of June, September, December, and March: Provided that when and so often as the advances are fully repaid the interest accrued thereon shall immediately become payable.

  1. (a) For the purposes of paragraph (a) of subsection one of section thirty-eight of the said Act the total amount of capital moneys expended in respect of the railways shall be deemed to be the aggregate of the following sums:—

(i) The amount of such capital moneys certified by the Controller and Auditor-General to have been expended in respect of the railways as at the first day of April, one thousand nine hundred and thirty-one, reduced by the sum of ten million four hundred thousand pounds as prescribed by subsection two of section twenty-three of the Government Railways Amendment Act, 1931:

(ii) The amount of moneys expended (including any imprest advances) on or after the first day of April, one thousand nine hundred and thirty-one, as shown by the Treasury accounts, down to the last day of every month in respect of the vote of the Public Works Fund called “Railways Improvements and Additions to Open Lines” Vote:

(iii) The amount of moneys, as recorded in the books of the Public Works Department, expended on or after the first day of April, one thousand nine hundred and thirty-one, on lines which became a Government railway open for traffic within the meaning of the Government Railways Act, 1926, at any time prior to that date. For the purposes of this paragraph such moneys shall be treated as capital moneys from the last day of the month in which the expenditure was so recorded:

(iv) The amount of moneys, as recorded in the books of the Public Works Department, expended whether before, on, or after the first day of April, one thousand nine hundred and thirty-one, on lines which at any time on or after that date have or do become a Government railway open for traffic within the meaning of the Government Railways Act, 1926. For the purposes of this paragraph the moneys expended down to the date upon which a line becomes open for traffic shall be treated as capital moneys on such date, and the moneys subsequently expended on such line shall be treated as capital moneys from the last day of the month in which the expenditure was so recorded:

(v) The amount of moneys expended on or after the first day of April, one thousand nine hundred and thirty-one, as charges and expenses of raising by way of loan any moneys referred to in paragraphs (ii), (iii), and (iv) of this present clause three (subject to apportionment as allocated in the records of the Treasury in the case of loans raised partly for other purposes):

(vi) The amount of Public Works administration and supervision charges incurred on or after the first day of April, one thousand nine hundred and thirty-one, in respect of construction of railways as allocated in the records of the Treasury or Public Works Departments.

(b) The total amount of capital moneys expended in respect of the railways determined in the manner prescribed by paragraph (a) of this clause shall be reduced by the amount of any moneys lawfully paid on or after the first day of April, one thousand nine hundred and thirty-one, from the Working Railways Account down to the last day of every month to
