The South-western Side of Portion of Lonsdale Street, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 3rd day of July, 1935.

Present:

THE HON. SIR ALFRED RANSOM PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in any-wise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the tenth day of June, one thousand nine hundred and thirty-five, viz. :—

“ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to portion of the south-western side of Lonsdale Street, in the said City of Dunedin, where such portion of street abuts on Lot 7, Block XI, Belleknowes Estate, as the said portion of street is more particularly shown on the plan annexed hereto and is thereon coloured brown and edged with red to its centre-line ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of the portion of Lonsdale Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE south-western side of all that portion of street, situated in the Otago Land District, City of Dunedin, known as Lonsdale Street, fronting Allotment 7, Block XI, Belleknowes Estate. As the said portion of street is more particularly delineated on the plan marked P.W.D. 89714, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolutions passed by the Auckland City Council and the Ellerslie Town Board on the sixth and eleventh days of June, one thousand nine hundred and thirty-five, respectively, viz. :—

“ The Auckland City Council, being the local authority having control of the streets in the City of Auckland, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Wairakei Street adjoining part of Lot 35, D.P. 293, being part of Allotment 7 of Section 12, Suburbs of Auckland, and Lot 36, D.P. 293, of part Allotments 7 and 59, Section 12, Suburbs of Auckland ;

“ That the Ellerslie Town Board, being the local authority having control of the streets within the Town District of Ellerslie, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of street known as Wairakei Street, Ellerslie, adjoining that piece of land being part of Lot 36, D.P. 293, being part of Allotments 7 and 59 of 12, Suburbs of Auckland ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Wairakei Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

THE south-eastern side of all that portion of street, situated in the North Auckland Land District, City of Auckland and Town District of Ellerslie, known as Wairakei Street, fronting part Lot 35 and Lot 36, D.P. 293, being parts Allotments 7 and 59 of Section 12, Suburbs of Auckland. As the said portion of street is more particularly delineated on the plan marked P.W.D. 89330, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Validating Loans Conversion Proceedings of Wairoa Borough Council.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 3rd day of July, 1935.

Present:

THE HON. SIR ALFRED RANSOM PRESIDING IN COUNCIL.

WHEREAS by an Order in Council known as the Wairoa Borough Loans Conversion Order, 1934, dated the twenty-fifth day of January, one thousand nine hundred and thirty-four, and published in the Gazette of the first day of February, one thousand nine hundred and thirty-four, at page 140 thereof, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by the Local Authorities Interest Reduction and Loans Conversion Act, 1932–33 (hereinafter called “the said Act”), did consent to the issue by the Wairoa Borough Council (hereinafter called “the said Council”) of new securities in conversion of any existing securities to which the said Order applies, and did thereby make the provisions contained in the said Order in Council:

And whereas by a resolution passed at a special meeting of the said Council and confirmed at a subsequent meeting held not sooner than fourteen days after the day of such special meeting, the said Council resolved to issue new securities in conversion of the existing securities to which the said Order applies, but the public notice of the place and date fixed for such subsequent meeting and of the purpose of the resolution to be confirmed thereat was not given in the period intervening between the two meetings twice or more as required by subsection two of section nine of the said Act:

And whereas it is desirable to validate the proceedings affected by the said omission to give such notice at least twice:

Now, therefore, in pursuance and exercise of the powers and authorities conferred on him by section two of the Local Authorities Interest Reduction and Loans Conversion Amendment Act, 1934, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the proceedings of the said Council in connection with the said resolution and the said notice shall be valid to all intents and purposes as though the public notice under subsection two of section nine of the said Act had been published at least twice, and that neither the said proceedings nor any new securities issued by the said Council shall hereafter be questioned in any Court on the ground of any such omission aforesaid.
