Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 30th day of January, 1934.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 25th day of January, 1934.

THE RIGHT HON. J. G. COATES PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred upon him by the Cemeteries Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke, in so far as it relates to the cemeteries named in the Schedule hereto, the Order in Council delegating powers under the said Act made on the eighteenth day of September, one thousand nine hundred and thirty-three, and published in the Gazette on the twenty-first day of the same month, at page 2429.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 25th day of January, 1934.

Present:
THE RIGHT HON. J. G. COATES PRESIDING IN COUNCIL.

WHEREAS the lands and licenses or interests in land described in the second column of the Schedule hereto are lands and licenses or interests in land in Western Samoa belonging to the Church of Jesus Christ of Latter-Day Saints: And whereas such lands and licenses or interests in land have been granted or acquired and are now registered in the Land Register of Western Samoa in the respective volumes and folios thereof set out in the third column of the said Schedule in the several names respectively appearing in the first column of the said Schedule opposite to the descriptions of the said several lands contained in the second column of the said Schedule: And whereas none of such names represents any existing person or body corporate: And whereas it is expedient that all such lands should be vested in the Corporation of the Presiding Bishop of the Church of Jesus Christ of Latter-Day Saints, a corporation sole created and existing under the laws of the State of Utah, United States of America, and carrying on business there and in Pesega in Western Samoa and elsewhere: And whereas legislation is necessary to enable such lands to be so vested:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of that Dominion, and in pursuance of the authority to make regulations for the peace, order, and good government of Samoa conferred upon him by the Samoa Act, 1921, and of all other powers and authorities enabling him in that behalf, doth hereby order as follows:—

  1. These regulations may be cited as the Samoa Church of Jesus Christ of Latter-Day Saints Order, 1934, and shall come into force on the first day of February, one thousand nine hundred and thirty-four.

  2. The several freehold lands and licenses or interests in land described in the second column of the Schedule which belong to the Church of Jesus Christ of Latter-Day Saints and which are registered in the Land Register of Western Samoa in the respective names appearing in the first column of the Schedule under the respective references appearing in the third column of the Schedule shall vest in and be held by the Corporation of the Presiding Bishop of the Church of Jesus Christ of Latter-Day Saints, a corporation sole created and existing under the laws of the State of Utah, United States of America, and the successors and assigns for ever of the said corporation sole, subject, nevertheless, to all such encumbrances and other interests, if any, as the same are now subject to, and subject to the trusts and purposes for which such lands may have been granted or acquired.

  3. The provisions of the Companies Ordinance, 1920, relating to foreign companies shall apply to the said corporation sole.
