Order in Council varying the Conditions as to the Borrowing and Repayment of Specified Loans of the Chatham Islands County Council.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 28th day of February, 1934.

Present:
THE RIGHT HON. G. W. FORBES PRESIDING IN COUNCIL.

WHEREAS by Orders in Council made on the respective dates stated in the Second Column of the Schedule hereto, and subject to the determinations as to the borrowing and repayment set out in the said Orders in Council respectively, consent was given to the raising by the Chatham Islands County Council (hereinafter called “the said local authority”) of the two loans enumerated in the First Column of the said Schedule, up to the respective amounts specified in the Third Column of the said Schedule; and the respective amounts, totalling one thousand pounds (£1,000), (hereinafter called “the said sum”) shown in the Fourth Column of the said Schedule have not yet been raised:

And whereas it is expedient to vary certain of the determinations aforesaid in respect of the said sum:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926 (as set out in section twenty-nine of the Finance Act, 1932 (No. 2)), and of all other powers and authorities enabling him in this behalf, doth hereby vary certain of the determinations aforesaid by prescribing that the said sum or any part thereof may be raised by the said local authority at such rate or rates of interest as shall not produce to the lender or lenders a rate exceeding four pounds ten shillings (£4 10s.) per centum per annum (for the term, namely, twenty-five years, as prescribed by the aforesaid Orders in Council), and that the rate of payments to the sinking fund established for the repayment of the said sums shall be not less than two pounds eight shillings (£2 8s.) per centum.

Order in Council authorizing the Borrowing by the Auckland and Suburban Drainage Board by way of Hypothecation of Debentures issued in respect of a Loan of £95,000.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 28th day of February, 1934.

WHEREAS by Order in Council made on the fourth day of December, one thousand nine hundred and thirty-three, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in London by the Auckland and Suburban Drainage Board (hereinafter called “the said local authority”) of the sum of ninety-five thousand pounds (£95,000) by a special loan to be known as “Loan No. 11, 1934” (hereinafter called “the said loan”):

And whereas the said local authority, pending the raising of the said loan in accordance with the determinations aforesaid, is desirous of borrowing such sum by the hypothecation or mortgage, pursuant to section thirty-four of the Local Bodies’ Loans Act, 1926, of the debentures authorized to be issued in respect of the said loan:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and by section seven of the Local Authorities Interest Reduction and Loans Conversion Act, 1932–33, and of all other powers and authorities enabling him in this behalf, doth hereby consent to the said local authority, pending the raising of the said loan in accordance with the determinations aforesaid (by which, inter alia, the rate of interest to be inserted in the said debentures is limited to four pounds (£4) per centum), borrowing the said sum of £95,000 by the hypothecation or mortgage of the said debentures at a rate of interest not exceeding five pounds (£5) per centum per annum.

Fixing the Rate of Interest payable on the Amount of Loans granted under Section 22 of the State Advances Amendment Act, 1922, and Section 9 of the Finance Act, 1933.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 28th day of February, 1934.

THE RIGHT HON. G. W. FORBES PRESIDING IN COUNCIL.

IN pursuance and exercise of the power and authority conferred on him by section nine of the Finance Act, 1933, and by the State Advances Act, 1913, and of all other powers and authorities in that behalf enabling him, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that interest on the amount of loans granted under section twenty-two of the State Advances Amendment Act, 1922, as amended by section nine of the Finance Act, 1933, and for the time being outstanding shall be payable at the rate of six per centum per annum.
