of the said Dominion, do hereby order and declare that the reserve for recreation in the North Auckland Land District described in the Schedule hereto shall be and the same is hereby brought under the operation of and declared to be subject to the provisions of Part II of the said Act, and such reserve shall hereafter form part of the Motuihi Island Domain, and be managed, administered, and dealt with as a public domain by the Motuihi Island Domain Board.

SCHEDULE.

ALL that area in the North Auckland Land District, containing by admeasurement 1 rood 1·6 perches, more or less, being portion of Motuihi Island, Block XIII, Rangitoto Survey District: Bounded commencing at a point bearing 75° 22′, distance 34·87 links from iron spike XII, S.O. 25853; towards the north-west generally by portion of Motuihi Island (Quarantine Station) by lines bearing 62° 29′, distance 21·38 links, bearing 17° 22′, distance 277·14 links; towards the north-east by portion of Motuihi Island (Motuihi Island Domain) by a line bearing 140° 29′ 30″, distance 119·41 links; towards the south-east generally by the last-mentioned portion of Motuihi Island by lines bearing 197° 22′, distance 215·1 links, bearing 244° 34′, distance 18·2 links; towards the south-west by that portion of Motuihi Island aforesaid by a line bearing 287° 36′ 30″, distance 101·80 links, to the point of commencement: be all the aforesaid measurements a little more or less. As the same is more particularly delineated on the plan marked L. and S. 22/2250A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red. Withdrawing Land from the Operation of the Kauri-gum Industry Act, 1908.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 28th day of February, 1934.

Present:

THE RIGHT HON. G. W. FORBES PRESIDING IN COUNCIL.

WHEREAS by section one hundred and sixty-two of the Land Act, 1924, it is enacted that the Governor-General may, by Order in Council, on the recommendation of the Land Board, declare that any land comprised in a kauri-gum reserve shall, from a date to be specified in the Order, cease to be subject to the Kauri-gum Industry Act, 1908, and on and after the date so specified the land to which the Order relates shall become subject to the provisions of the Land Act, 1924:

And whereas the Land Board of the North Auckland Land District has duly passed a resolution recommending that portion of the Rotoroa Kauri-gum Reserve Extension, as described in the Schedule hereto, be excepted from the operations of the Kauri-gum Industry Act, 1908, and it is expedient to give effect to such recommendation:

Now, therefore, I, Charles, Baron Bledisloe, Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon me by section one hundred and sixty-two of the Land Act, 1924, and acting by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the portion of the Rotoroa Kauri-gum Reserve Extension, as described in the Schedule hereto, shall, from the fifth day of March, one thousand nine hundred and thirty-four, cease to be subject to the Kauri-gum Industry Act, 1908.

SCHEDULE.

ALL that area in the North Auckland Land District, containing by admeasurement 155 acres 2 roods 14 perches, more or less, being part of the Rotoroa Kauri-gum Reserve Extension as described in the New Zealand Gazette, 1899, No. 60, page 1302: Bounded commencing at the northernmost corner of Section 9, Block VIII, Opoe Survey District; towards the north-west by the other part of the Rotoroa Kauri-gum Reserve Extension aforesaid, 731·8, 1011·2, 987·1, and 2330·0 links; towards the north-east by a public road, 589·0, 329·2, 508·5, 373·1, and 359·3 links; towards the south-east by Section 17, Block VIII, Opoe Survey District, 1980·6 links; towards the north-east by Section 17 aforesaid and the other part of the Rotoroa Kauri-gum Reserve Extension aforesaid, 1106·3 and 625·4 links respectively; towards the south-east by Section 19, Block VIII, Opoe Survey District, 779·7 links; towards the north-east by Section 19 aforesaid to Peg III shown on a plan numbered 22875, lodged in the office of the Chief Surveyor at Auckland, 696·0 links; towards the south-east by a right line bearing 251° 20′ from Peg III aforesaid to Lake Nga Kapua; towards the south generally by the said lake; towards the north-west by a public road 320·0 and 886·7 links; towards the south-west by the abutment of a public road 130·0 links; towards the west and south-east generally by a lake to a point on the margin of that lake in line with the north-eastern boundary of Section 9, Block VIII, Opoe Survey District; towards the south-west by the other part of the Rotoroa Kauri-gum Reserve Extension aforesaid and by Section 9, Block VIII, Opoe Survey District, to the point of commencement, 1058·4 links: be all the aforesaid linkages a little more or less. As the same is more particularly delineated on a plan marked L. and S. 22/1747F, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red. The North-western Side of Portion of a Road in the County of Waimea exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 28th day of February, 1934.

Present:

THE RIGHT HON. G. W. FORBES PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waimea County Council on the ninth day of February, one thousand nine hundred and thirty-four, viz. :—

“ That the Waimea County Council, being the local authority having control of the roads within the Waimea County, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-western side of the road fronting the south-eastern boundary of part Section 75, Block III, Waimea Survey District, as shown on plan prepared by C. M. Hoult, Registered Surveyor, and coloured red thereon ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portion of road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.

SCHEDULE.

THE north-western side of all that portion of road, situated in the Nelson Land District, County of Waimea, fronting part Section 75, Suburban South, Block III, Waimea Survey District. As the same is more particularly delineated on the plan marked P.W.D. 86884, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
