of any premises in or about which such newspaper is found, or in the case of premises owned, leased, or occupied by a body corporate or a partnership, is a director, officer, or servant of such body corporate or is a member or servant of such partnership shall be deemed to have such newspaper in his possession for the purpose of the sale and distribution thereof in Samoa, unless he shall satisfy the High Court that the said newspaper was in his possession, or in and about such premises as the case may be, without his knowledge or consent.

  1. Administrator may authorize Importation and Publication.—The Administrator may by permit under his hand authorize the importation into Samoa, or the printing, publication, sale, or distribution therein, of any newspaper printed in the Samoan language, or partly in that language and partly in any other language, but subject to and in accordance with the provisions hereinafter appearing.

  2. Application for Permit.—Every application for a permit under the last preceding clause shall be in the form set out and contain the information indicated in the First Schedule hereto, and shall be supported by a statutory declaration as therein provided.

  3. Grant of Permit.—If the Administrator is satisfied that the importation, printing, publication, sale, or distribution of the said newspaper is not likely to cause disaffection or disloyalty or to hinder the administration of the executive government of the Territory or to prejudicially affect the peace, order, and good government of Samoa, he may grant the said application.

  4. Extent of Permit.—A permit granted under the last preceding clause hereof shall extend only to the issue of the newspaper specified in the application for the permit, and not to any subsequent issues thereof.

PART II.

SEDITIOUS NEWSPAPERS.

  1. Seditious Newspaper defined.—A seditious newspaper means any newspaper which incites, encourages, advises, or advocates violence, lawlessness, and disorder, or expresses any seditious intention, or misrepresents or tends to bring into hatred or contempt the Parliament or Executive Government of New Zealand or the Administration or Public Service of the Territory by intemperate language, malicious or reckless criticism, or otherwise tends to interfere with the peace, order, or good government of the Territory, and includes every issue of any newspaper which the Administrator shall by notice published in the Gazette declare to be a seditious newspaper, whether printed before or after such notice and whether within or without the Territory.

  2. Importation and Publication prohibited.—It shall be unlawful for any person to import into Samoa or to print, publish, sell, or distribute therein any seditious newspaper.

  3. Possession for Sale or Distribution.—It shall be unlawful for any person to have in his possession for sale or distribution in Samoa any seditious newspaper.

PART III.

GENERAL.

  1. Postal Packets may be detained.—Where the Postmaster at Apia has reason to suspect that any postal packet contains any newspaper, the importation, printing, publication, sale, or distribution of which is prohibited by Part I or Part II of this Order, he may detain such postal packet with its contents, and the same shall be opened, examined, and dealt with in manner hereinafter mentioned.

  2. Mode of opening Postal Packets.—Every postal packet detained as aforesaid shall be opened and examined by the said Postmaster in the presence of two members of the Samoan Public Service specially nominated for that purpose by the Administrator. Such persons shall not disclose any matters discovered by them in the course of such examination, except for the purpose of enforcing this Order.
