ORDER IN COUNCIL.
At the Government House at Wellington, this 15th day of December, 1933.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
HIS Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of that Dominion, and in pursuance of the authority to make regulations for the peace, order, and good government of Samoa conferred upon him by the Samoa Act, 1921, and of all other powers and authorities enabling him in that behalf, doth hereby make the following regulations.
REGULATIONS.

Short Title.—This Order may be cited as the Samoa Publications Order, 1933, and shall come into force on the first day of January, one thousand nine hundred and thirty-four.

Interpretation.—In this Order, where not inconsistent with the context,—
“Administrator” means the Administrator of Western Samoa :
“Gazette” means the Western Samoa Gazette ;
“Newspaper” includes any newspaper, journal, magazine, circular, pamphlet, book, hand-bill, document, or any other illustrated or printed matter, whether published periodically or irregularly, or on only one occasion, which is intended or is likely to be read or seen by or read or communicated to the general public or any part or section thereof :
“Postal packet” includes a letter, post-card, letter-card, newspaper, book, packet, pattern, or sample packet, parcel, and every other packet or article transmissible by post :
“Printed” includes any form of writing, drawing, typing, printing, cyclostyling, or any reproduction of any of such methods and any picture or photographic reproduction, whether produced by hand or mechanical device.
PART I.
NEWSPAPERS IN SAMOAN LANGUAGE.

Official, Religious, and Trade Publications exempted.—The provisions of this Part of this Order shall not apply to any newspaper published by or under the authority of the Executive Government of Samoa or to any newspaper of any missionary or Church organization operating in Samoa which relates to matters connected with work of such organization or to any advertisement or announcement published in any newspaper in the ordinary manner and form of commercial advertising and containing only matter wholly of a commercial nature.

Importation and Publication prohibited.—Save in accordance with the provisions hereinafter appearing, it shall be unlawful to import into Samoa or to print, publish, sell, or distribute therein any newspaper printed in the Samoan language or partly in that language and partly in any other language.

Possession for Sale or Distribution.—It shall be unlawful for any person to have in his possession for the purpose of sale or distribution in Samoa any newspaper the importation or publication whereof is prohibited under the preceding clause.

Presumptions as to Purpose.—Any person who has in his possession one or more copies of any such newspaper (or any seditious newspaper as defined by Part II of this Order) or is the owner, lessee, or occupier
