  1. Disposal of Postal Packet.—If on any such examination the said postal packet is found to contain any newspaper as aforesaid the said packet shall be forfeited to His Majesty, and shall be disposed of in such manner as the Administrator shall direct; but such forfeiture and disposal shall not affect any liability to penalty or punishment to which the sender or addressee, or any other person, may be subject under the provisions of this Order.

  2. Penalties.—Every person is liable to one year’s imprisonment or to a fine of £200 or, in the case of a body corporate, to a fine of £500 who disobeys any of the provisions of this Order by wilfully doing any act which it forbids or omitting to do any act which it requires to be done.

  3. Application of Customs Acts.—This Order shall be deemed to be included in the term “the Customs Acts” as used in the Customs Act, 1913, but the penalty prescribed by subsection five of section forty-six of the said Act shall be increased to the extent specified in the last preceding clause hereof in respect of newspapers imported into Samoa in breach of the provisions of this Order.

FORM OF APPLICATION FOR PERMIT UNDER THE SAMOA PUBLICATIONS ORDER, 1933.

  1. All particulars inserted in the above application are true and correct in every respect.

Annexed hereto and marked with the letter “A” is a true and fair translation into the English language of [so much of the said newspaper to be imported by me as is printed in the Samoan language] [so much of the contents of the said newspaper to be printed and published by me as is to be printed in the Samoan language].

And I make this solemn declaration, conscientiously believing the same to be true, and by virtue of the provisions of section 365 of the Samoa Act, 1921.
