The Eastern Side generally of Portion of the Porirua-Titahi Bay Road, in the County of Makara, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 4th day of December, 1933.
Present:
His Excellency the Governor-General in Council.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Makara County Council on the tenth day of November, one thousand nine hundred and thirty-three, viz.:
“The Makara County Council, being the local authority having control of the roads in the County of Makara, hereby resolves and declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the eastern side of the Porirua-Titahi Bay Road abutting on part Kenepuru 1A Block, Block I, Belmont Survey District, contained in Certificate of Title, Volume 415, folio 232, and having a frontage of 901·58 links to the said road ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the eastern side generally of the portion of road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.

SCHEDULE.
THE eastern side generally of all that portion of road, situated in the Wellington Land District, County of Makara, known as the Porirua-Titahi Bay Road, fronting part Kenepuru 1A Block, Block I, Belmont Survey District. As the same is more particularly delineated on the plan marked P.W.D. 86520, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

His Excellency the Governor-General in Council.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the West Harbour Borough Council on the seventh day of November, one thousand nine hundred and thirty-three, viz.:
“That the West Harbour Borough Council, being the local authority having control of the streets in the West Harbour Borough, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to portions of the eastern side of Royal Terrace, in the said West Harbour Borough, where such portions of the street abut Allotment 34, Township of Rothesay ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the eastern side of the portion of Royal Terrace (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE.
THE eastern side of all that portion of street, situated in the Otago Land District, Borough of West Harbour, known as Royal Terrace, fronting Lot 34, Township of Rothesay. As the said portion of street is more particularly delineated on the plan marked P.W.D. 86478, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.

Variation of Order in Council prohibiting Alienation of certain Native Land.

ORDER IN COUNCIL.
At the Government House at Wellington, this 4th day of December, 1933.
Present:
His Excellency the Governor-General in Council.
WHEREAS it is enacted by section one hundred and sixty-seven of the Native Land Act, 1931, that an Order in Council made thereunder may at any time be varied or revoked:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance of the power and authority vested in him, doth hereby vary an Order in Council made under the said section one hundred and sixty-seven dated the nineteenth day of September, one thousand nine hundred and thirty-two, regarding Rotokautuku 2B and other blocks, set out in the Schedule to such Order in Council, by excluding and excepting from prohibition of alienation the land set out in the Schedule hereto.

Vesting a Reserve in the Wairoa County Council.

ORDER IN COUNCIL.
At the Government House at Wellington, this 4th day of December, 1933.

His Excellency the Governor-General in Council.
WHEREAS the land described in the Schedule hereto has been duly set apart for plantation purposes:
And whereas, in the opinion of the Governor-General, it is expedient to vest the said reserve in the Chairman, Councillors, and Inhabitants of the County of Wairoa:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section nine of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby declare that, from and after the day of the date hereof, the reserve described in the Schedule hereto shall become vested in the Chairman, Councillors, and Inhabitants of the County of Wairoa in trust for plantation purposes.
