Order in Council consenting to the Raising of a Loan of £1,400 by the Warkworth Town Board and prescribing the Terms thereof.

ORDER IN COUNCIL.

At the Government House at Wellington, this 21st day of August, 1933.

Present:

His Excellency THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS the Warkworth Town Board (hereinafter called “the said local authority”) proposes, pursuant to the terms of a requisition issued under section twenty-two of the Health Act, 1920, to raise the sum of one thousand four hundred pounds (£1,400) by a loan to be known as “Water-supply Loan, 1933,” for the purpose of undertaking the first section of a scheme for providing adequate water-supply for the Town District, and has applied for the necessary consenting Order in Council:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising by the said local authority of the said loan up to the amount of one thousand four hundred pounds (£1,400), and in giving such consent doth hereby determine as follows:—

  1. The term for which the said loan or any part thereof may be raised shall not exceed twenty-five (25) years.

  2. The rate of interest that may be paid in respect of the said loan or any part thereof shall be such as shall not produce to the lender or lenders a rate exceeding four pounds five shillings (£4 5s.) per centum per annum.

  3. The said local authority shall, before raising the said loan or any part thereof, make provision for the repayment thereof by establishing a sinking fund under the Local Bodies' Loans Act, 1926, or under such other statutory enactment as may be applicable, and shall thereafter make payments to such sinking fund at intervals of not more than one year, at a rate or rates per centum which shall be not less than two pounds eight shillings (£2 8s.), such payments to be made in respect of every part of the said loan for the time being so raised and not repaid, the first such payment to be made not later than one year after the first day from which interest to the lender or lenders is computed on any moneys so raised.

  4. The rate of brokerage that may be paid in respect of the raising of the said loan or any part thereof shall not exceed one-half per centum on any amount raised.

  5. No amount payable as either interest or sinking fund in respect of any moneys raised pursuant to this consent shall be paid out of such moneys.

Order in Council consenting to the Raising of a Loan of £115 by the Pukekohe Borough Council.

ORDER IN COUNCIL.

At the Government House at Wellington, this 21st day of August, 1933.

Present:

His Excellency THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS the Pukekohe Borough Council (hereinafter called “the said local authority”) proposes to raise pursuant to the terms of a Warrant issued under section one hundred and thirty-five of the Public Works Act, 1928, the sum of one hundred and fifteen pounds (£115) by a loan to be known as “Tuakau Bridge Loan, 1933,” for the purpose of meeting the balance of its share of the cost of constructing a bridge (together with approaches thereto) over the Waikato River at Tuakau, on the Pukekohe–Glen Murray via Tuakau Main Highway:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by the Local Government Loans Board Act, 1926, and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising by the said local authority of the said loan up to the amount of one hundred and fifteen pounds (£115) for a term not exceeding thirty-six and a half (36½) years at such rate or rates of interest as shall not produce to the lenders a rate exceeding the rate of four pounds five shillings per centum per annum, subject to the condition that the said local authority shall, before borrowing the said sum or any part thereof, make provision for the repayment thereof by establishing a sinking fund under the Local Bodies' Loans Act, 1926, and shall thereafter make to such sinking fund payments at intervals of not more than one year at a rate or rates which shall be not less than the rate of one pound five shillings (£1 5s.) per centum, such payments to be made in respect of every part of the said sum for the time being so borrowed and not repaid, and the first payment to be made not later than one year after the first day from which interest to the lender is computed on any moneys so borrowed, and subject to the further condition that no portion of interest or sinking fund shall be paid out of loan-moneys.

Order in Council varying certain of the Determinations in connection with the Borrowing and Repayment of Portion—viz., £11,550—of the Central Hawke's Bay Electric-power Board's Loan of £11,875.

ORDER IN COUNCIL.

At the Government House at Wellington, this 21st day of August, 1933.

Present:

His Excellency THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by Order in Council made on the fourteenth day of March, one thousand nine hundred and thirty-two, and subject to the determinations as to the borrowing and repayment therein set out, consent was given to the raising by the Central Hawke's Bay Electric-power Board (hereinafter called “the said local authority”) of the sum of eleven thousand eight hundred and seventy-five pounds (£11,875) by a loan to be known as “Redemption Loan No. 1, 1932” (hereinafter called “the said loan”):

And whereas certain of the determinations aforesaid are that the said loan may be raised at a rate of interest not exceeding five pounds five shillings (£5 5s.) per centum per annum, for a term of twenty-six years, and that provision for the repayment thereof shall be made by the establishment of a sinking fund of not less than two per cent. :

And whereas by reason of section six of the Local Authorities Interest Reduction and Loans Conversion Act, 1932–33, the rate of interest payable in respect of the said loan is reduced to a rate not in excess of four pounds five shillings (£4 5s.) per centum per annum:

And whereas the said loan has not yet been raised, and it is expedient that the said local authority may be authorized to raise the said loan to the extent of eleven thousand five hundred and fifty pounds (£11,550) on the instalment-repayment system:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and by section thirty-two of the Local Bodies' Loans Act, 1926, and of all other powers and authorities enabling him in this behalf, doth hereby vary certain of the determinations aforesaid by prescribing that the said sum of eleven thousand five hundred and fifty pounds (£11,550), or any part thereof, may be raised by the said local authority upon terms of making such sum, together with interest thereon at a rate not exceeding the aforesaid rate of £4 5s. per centum per annum, repayable by equal aggregate annual or half-yearly instalments extending over a term not exceeding twenty-six (26) years.
