Authorizing the Whangarei Harbour Board to Reclaim Land near the Waiarohia Stream, Whangarei Harbour.

ORDER IN COUNCIL.

At the Government House at Wellington, this 10th day of April, 1933.

Present.

His Excellency the Governor-General in Council.

WHEREAS it is provided by the one hundred and sixty-eighth section of the Harbours Act, 1923 (hereinafter called the “said Act”), that the Governor-General may from time to time, by Order in Council, authorize any local authority or Harbour Board to reclaim from the sea areas, not exceeding five acres in extent, in any case where he considers that the reclamation will not affect navigation and is for the benefit of the public.

And whereas the Whangarei Harbour Board (hereinafter called “the Board”) is desirous of reclaiming from the sea certain land near the Waiarohia Stream, in Whangarei Harbour, and the said reclamation is of such a nature as aforesaid, and the Board has applied to the Governor-General in Council for an order authorizing the execution of the said harbour-works:

And whereas it has been made to appear to the Governor-General in Council that the proposed work will not be or tend to the injury of navigation, and is for the benefit of the public:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize and empower the Board to reclaim from the sea near Waiarohia Stream, in Whangarei Harbour, the land shown edged in red on plan marked M.D. 7128, and deposited in the office of the Marine Department at Wellington, such reclamation to be carried out and constructed in accordance with plan marked M.D. 7128, subject to the provisions of the said Act.

Amending Regulations for Whitebait Fishing in the Hawke’s Bay Provincial District.

At the Government House at Wellington, this 10th day of April, 1933.

His Excellency the Governor-General in Council.

WHEREAS by Order in Council dated the twenty-sixth day of September, one thousand nine hundred and thirty-two, and published in the Gazette of the sixth day of the following month, at page 2086, amending regulations for whitebait fishing were made under the Fisheries Act, 1908:

And whereas it is desirable to amend such regulations:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by the said Act, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend the said regulations of the twenty-sixth day of September, one thousand nine hundred and thirty-two, in the manner set out in the Schedule hereto.

SCHEDULE.

REGULATION 5 is hereby amended by adding the following proviso thereto:—

Provided, further, that in all the rivers and their tributaries in the Hawke’s Bay Provincial District it shall be lawful to use a hand-net, the area of the mouth of which shall not exceed 8 square feet.

Clause 1 of the Second Schedule to the said regulations is hereby amended by deleting all words after the word “exceed” in line two thereof, and substituting in lieu thereof the words “8 square feet.”

Cancelling the Reservation over Part of a Reserve in Blocks XV and XVI, Tutamoe Survey District, North Auckland Land District.

ORDER IN COUNCIL.

At the Government House at Wellington, this 10th day of April, 1933.

Present:

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers and authorities conferred upon him by subsection one (b) of section seven of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby cancel the reservation as a forest reserve (climatic) over the land described in the Schedule hereto; and doth hereby declare that the said land, being vested in the Crown, is Crown land available for disposal under the Land Act, 1924.

SCHEDULE.

ALL that area in the North Auckland Land District, containing by admeasurement 226 acres, more or less, being part Section 12, Block XV, and part Section 4, Block XVI, Tutamoe Survey District, proclaimed Forest reserve (climatic) Gazette 1902, pages 1908 and 1909: Bounded towards the north generally by Section 7, Block XVI, Tutamoe Survey District, 119·3, 357·1, 588·2, 477·8, 738·2, 394·6, 271·9, 497·2, 366·2, 289·4, 409·3, 200·6, and 1398·2 links; towards the east generally by Section 1, Block XVI aforesaid, 1830·5 and 1698·8 links; towards the south by Crown land, 4507 links; towards the west and again towards the south by State Forest No. 14, gazetted 1886, page 1304, 2016 and 2796·5 links respectively; and again towards the west generally by other part Section 12, Block XV aforesaid, gazetted forest reserve (climatic) in 1902, pages 1908 and 1909, and Section 23, Block XV, Tutamoe Survey District 969·9, 343·1, 135·6, 177·3, 199·5, 329·4, 141·5, 178·4, 173·5, 111·6, 250·0, 341·6, and 161·2 links respectively: Be all the aforesaid linkages more or less: as the same is more particularly delineated on the plan marked L. and S. 22/194/149A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red. Changing the Purpose of a Reserve in Suburbs of Mataroa Township, Wellington Land District.

ORDER IN COUNCIL.

At the Government House at Wellington, this 10th day of April, 1933.

Present:

His Excellency the Governor-General in Council.

WHEREAS the land described in the Schedule hereto is a reserve duly set apart for growth and preservation of scenery:

And whereas it is expedient that the purpose of the reservation over such land shall be changed to a reserve for a resting-place for travelling stock:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by subsection one (a) of section seven of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby declare that the purpose of the reserve described in the Schedule hereto is hereby changed from a reserve for growth and preservation of scenery to a reserve for a resting-place for travelling stock.

WELLINGTON LAND DISTRICT.

SECTION 20, Suburbs of Mataroa Township: Area, 3 acres 1 rood 8 perches, more or less.
