And whereas such loan authority was obtained in error and no portion thereof has been raised and borrowed for the purposes aforesaid :

And whereas the Minister of Finance has duly notified the Ashburton Borough Council in writing of his intention to cancel the loan authority :

Now, therefore, in exercise of the powers in that behalf conferred upon me by section 118 of the Local Bodies’ Loans Act, 1926, as amended by section 46 of the Finance Act, 1931 (No. 4), and of all other powers me in this behalf enabling, I, William Downie Stewart, Minister of Finance, do hereby cancel the authority of the Ashburton Borough Council to borrow, under the loan authority hereinbefore referred to, the sum of one thousand five hundred and seventy-five pounds (£1,575).

Auckland City Council.—Cancellation of Unexercised Loan Authority.

In the matter of section 118 of the Local Bodies’ Loans Act, 1926.

WHEREAS the Avondale Borough Council has been duly authorized to borrow by way of special loan the sum of six thousand pounds (£6,000) for purchasing road-making machinery and expenses incidental thereto, and the consent of the Governor-General in Council to the raising of the said loan was given by Order in Council made on the 17th day of November, 1922, and published in the Gazette on the 23rd day of the same month, at page 3076 :

And whereas the Avondale Borough Council has by Proclamation issued on the 1st day of September, 1927, been united with the City of Auckland :

And whereas in respect of the said sum of six thousand pounds (£6,000), there has been raised and borrowed for the purposes aforesaid the sum of five thousand nine hundred pounds (£5,900), and it has not been found necessary to borrow the whole of the amount so authorized :

And whereas the Minister of Finance has duly notified the Auckland City Council in writing of his intention to cancel the loan authority in so far as it has not been exercised :

Now, therefore, in exercise of the powers in that behalf conferred upon me by section 118 of the Local Bodies’ Loans Act, 1926, as amended by section 46 of the Finance Act, 1931 (No. 4), and of all other powers me in this behalf enabling, I, William Downie Stewart, Minister of Finance, do hereby cancel the authority of the Auckland City Council to borrow, under the loan authority hereinbefore referred to, the sum of one hundred pounds (£100) being the amount in respect of which the said loan authority has not been exercised : Provided always that this cancellation is without prejudice to the validity in all respects of the loan of five thousand nine hundred pounds (£5,900) already borrowed pursuant to the said loan authority.

In accordance with the provisions of section 13 (1) of the Local Bodies’ Loans Act, 1926, I hereby give you notice that at a poll of ratepayers of the whole of the Borough of Ashburton, held on the 8th day of December, 1932, on the proposal to borrow the sum of £2,300 for the purpose of increasing the high-pressure water-supply by the installation of additional plant and works at powerhouse and a new 12 in. main up Park Street, from the powerhouse to Havelock Street, including the necessary engineering charges incidental thereto, the following votes were cast :—

Against the proposal .. .. 80
Informal .. .. .. Nil

I therefore declare that the proposal was carried.

WHEREAS notice was published in the Gazette of 1932, page 285, of the Native Minister’s intention to apply the provisions of subsection (3) of section 522 of the Native Land Act, 1931, to Lot 1 of Section 148, Parish of Komakorau, and other subdivisions, and known as the Waikato Development Scheme :

Now, therefore, I, the said Native Minister, do decide to apply the provisions of the said subsection (3) to the additional land mentioned in the Schedule hereto as a part of such scheme, and hereby give notice of my intention accordingly.

No owner, except with the consent of the Native Minister, is entitled to exercise any rights of ownership in connection with the land affected so as to interfere with or obstruct the carrying-out of the development scheme.

Approval of Fees for Licensing of Vehicles fixed by By-laws.—Whakatane County Council.

Resolved : “ That pursuant to the powers vested in it in that behalf by section 2 of the Counties Amendment Act, 1931, the Wairoa County Council hereby resolves by way of special order that sections 121 and 131 of the Counties Act, 1920, shall not apply to the Wairoa County Council.”


We hereby certify that the foregoing special order was duly made at a special meeting of the Wairoa County Council held at the County Council Chambers, Queen Street, Wairoa, on Wednesday, the 9th day of November, 1932, and was duly confirmed at the ordinary monthly meeting of the said Council held on Wednesday, the 14th day of December, 1932, and that due notice of said special order was given in the Wairoa Star newspaper of the 16th, 23rd, and 30th days of November, and 7th day of December, 1932.
