HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance of the powers and authorities vested in him by the Fisheries Act, 1908, and its amendments, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulations for all that part of the Dominion known as the Otago Acclimatization District, as the same is defined in the First Schedule hereto, and the waters thereof, and doth hereby declare that these regulations shall, as from the date of publication thereof in the Gazette, supersede all regulations at variance therewith.

REGULATIONS.

  1. LICENSES to fish for trout, salmon, tench, and perch may be issued by the Secretary of the Otago Acclimatization Society or by any one authorized by such Secretary in that behalf, and every such license shall entitle the person named therein to fish in the Otago Acclimatization District for trout, salmon, tench, and perch from the first day of October in any one year to the thirtieth day of April in the year following (both dates inclusive), except for fishing and netting in Lake Hawea, its tributary rivers, Lake Wanaka, its tributary rivers, and the Hawea River, the season for which shall extend from the first day of November in any one year to the thirty-first day of May in the year following (both dates inclusive), subject to the said Acts and to these regulations: Provided that it shall be lawful for the Secretary or his deputy in any case where application is made before, on, or after the twentieth day of December in any year to issue a license to any man, but so that any such license shall extend from the said twentieth day of December, or from the time of granting the same (if granted later than the said twentieth day of December), until the termination of the then fishing season. Such license shall be termed “Half-season License,” and shall entitle the holder thereof to fish only in the waters of the Otago Acclimatization District: Provided that such Secretary may refuse to issue a license to any person who within the previous two years has been convicted of any breach of the provisions of any Act relating to fishing for trout, salmon, tench, or perch, or of any regulation made thereunder: Provided that the season for fishing in the waters known as Waipori Lake at Berwick shall close on the 15th day of April in each year.

  2. Such licenses shall be issued at the following rates: Licenses for men, £1 for the whole season; licenses for women, and for boys attending school or under the age of sixteen years, 5s. for the whole season; half-season licenses, as prescribed above, 12s. 6d. Such licenses shall be in the form or to the effect set forth in forms numbered one and two in the Second Schedule hereto.

  3. No license shall authorize any person other than the person named therein to fish, and that only with one rod and line, and with the following baits—namely, natural or artificial flies, insects, or fish, or with worms, creepers, maggots, caterpillars, frogs, or tadpoles, or with devons or spoons.

  4. No person shall take trout, salmon, tench, or perch in Lake Hawea, its tributary rivers, Lake Wanaka, its tributary rivers, and the Hawea River during the period commencing on the first day of June in any year and ending on the thirty-first day of October in the same year, nor in any other waters within the Otago Acclimatization District during the period commencing on the first day of May in any year and ending on the thirtieth day of September in the same year.

  5. No person shall have in his possession any trout, salmon, tench, or perch between the first day of June and the thirtieth day of September (both inclusive) in any year except in either case in freezing-works or a freezing-chamber.

  6. No person shall cast or throw into any river, stream, or waters in which trout, salmon, perch, or tench exist or have been liberated, or shall allow to flow or otherwise get into any such river, stream, or waters any sawdust or sawmill refuse, lime, sheep-dip, flax-mill refuse, or any other matter or liquid that is poisonous or injurious to fish, or place the same near the bank or margin of any such river, stream, or waters so that the same actually gets into the said river, stream, or waters as the result of any ordinary natural agency: Provided that nothing herein contained shall extend to prohibit the deposit in such river, stream, or waters of the debris of any mining claim, other than cyanide of potassium or other injurious chemicals that may be used in mining.

  7. No person shall fish for trout, salmon, perch, or tench without a license, and every person fishing for trout, salmon, tench, or perch, or any of them, shall on demand of any ranger, constable, or officer of the said society, or of any person producing a license, produce and show to such ranger constable, officer, or person his license and the contents of his creel or bag, and the bait used by him for taking, catching, or killing such trout, salmon, tench, or perch.

  8. Every trout or salmon not exceeding ten inches in length and every perch not exceeding six inches in length from nose to tip of tail, taken or caught by any person shall immediately be returned alive into the water from which the same is taken, and no person except as aforesaid shall have in his possession any trout or salmon not exceeding ten inches in length or any perch not exceeding six inches in length. The only exceptions to this clause shall be the streams known as the water of Leith, Waitati, Evansdale, and Glenomaru, and their branches, where the minimum length for trout or salmon that may be taken shall remain at nine inches.

  9. No person shall take trout, salmon, perch, or tench by cross-line fishing, stroke-hauling, or any other unsportsmanlike device or method; and except as provided in the Fisheries Act, 1908, or in these or any other regulations made thereunder, no trout, salmon, perch, or tench shall be taken or caught by any means whatsoever other than a rod and line, bait as aforesaid, and gaff or landing-net for the purpose of landing fish legitimately caught, and none of the above-mentioned baits shall be used with any medicated or chemical preparation whatsoever.

  10. No person shall take or fish for trout, salmon, tench, or perch by other than the following recognized methods: Natural bait, fly, or trolling, and only with the tackles and baits mentioned hereunder:—

Natural-bait fishing—worms, creepers, maggots, caterpillars, frogs, tadpoles, or whitebait, not more than two sets of baits, no set having more than two hooks.

Fly fishing—Not more than two flies or lures, each having only one hook.

Trolling—One artificial fish, one devon, or one spoon, and such artificial fish, devon, or spoon shall have not more than three treble hooks; or one fish with two treble hooks and one single hook attached, or the contrivance known as Stewart Tackle.

  1. Except as herein provided, no person shall put, stake, set, drag, draw, or place, or allow to be put, staked, set, dragged, drawn, or placed for any purpose whatsoever any net of any description except a landing-net or hand-net in any lake, river, stream, or dam, or within the mouth of any river or stream: Provided that nothing herein contained shall prevent the placing or using of any net other than a stake-net in or across the parts of the rivers and waters mentioned in the Third Schedule hereto, or prevent the taking of fish in accordance with any regulations made under the Fisheries Act, 1908.

  2. No person shall buy, sell, or expose or offer for sale any trout, salmon, tench, or perch, or any part of such fish unless he has a license authorizing him to do so issued under the Fisheries Act, 1908, or any regulations made thereunder.

  3. No person holding a license for taking trout, salmon, tench, or perch shall fish with more than one rod and line or with any bait other than such as are mentioned in Regulation 3 hereof.

  4. For the purpose of these regulations the mouth of every river or stream shall be deemed to include every outlet of the same and the sea-shore between such outlets, and shall include the sea and sea-shore within a radius of 500 yards from every point at which the waters of such river or stream meet those of the sea or of any inlet of the sea at low-water.

  5. Notwithstanding anything hereinbefore contained, no bait other than a natural or artificial fly or natural or artificial minnow shall be used for taking fish in any of the lagoons in the Roxburgh Amalgamated Company’s old workings, bounded on the south by the Molyneux River, on the east by the Teviot River and the main road, on the north by the main road Roxburgh to Alexandra, and on the west by the Ladysmith Company’s former claim: Provided that this regulation shall not apply to that dam or portion of the dam at Roxburgh at present held by Mr. W. Lutjens, Roxburgh, under occupation lease.

  6. Any person may net trout in Lake Hawea and Lake Wanaka provided that he holds a valid license to net trout therein, such license to be in the form numbered 3 in the Second Schedule hereto, and to be issued by the Otago Acclimatization Society.
