Regulations as to Foreshores.

BLEDISLOE, Governor-General.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 15th day of December, 1931.

Present:

THE RIGHT HON. G. W. FORBES, PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers and authorities conferred upon him by sections nine and two hundred and twenty-six of the Harbours Act, 1923, and of section five of the Fisheries Act, 1908, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulations as to foreshores vested in or under the control of His Majesty, and doth hereby order and declare that they shall come into and be in force on the date of their publication in the Gazette.

REGULATIONS.

  1. No person shall promote, conduct, or engage in any motor-vehicle speed tests or races in any portion of foreshore unless such person has first obtained the permission in writing of the Minister so to do.

  2. The granting of such permission shall be subject to such conditions and restrictions as the Minister may impose.

  3. (1) The Minister may—

(a) Prohibit, upon any day on which any speed tests or races hereinbefore referred to are held, the use of such foreshore by pedestrians or horsemen, or by any vehicles other than those engaged in such tests or races, and those required for the use of officials concerned therewith; and also the driving or bringing of stock upon such foreshore.

(b) Prohibit fishing or the taking of fish from such foreshore, or the conveyance on to such foreshore of any device for taking fish, on the day or days upon which such tests or races are held and for any period not exceeding one week prior to such day or days.

(c) From time to time appoint any officers required to carry out or assist in the administration of these regulations.

(2) Any person doing anything prohibited by the Minister from being done pursuant to this regulation shall be deemed to have committed a breach of these regulations.

  1. Any person committing a breach of any of these regulations shall be liable to a fine of £20.

Revoking Regulations under the Fisheries Act, 1908, and making others in lieu thereof.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 15th day of December, 1931.

THE RIGHT HON. G. W. FORBES, PRESIDING IN COUNCIL.

WHEREAS by Orders in Council dated the fifth day of March and the ninth day of July, one thousand nine hundred and twenty-eight, respectively, and published in the Gazette of the fifteenth day of March, one thousand nine hundred and twenty-eight, at page 702, and the twelfth day of July, one thousand nine hundred and twenty-eight, at page 2190, respectively, regulations were made prohibiting the use of nets for taking fish in certain waters:

And whereas it is desirable to revoke the said regulations and to make another in lieu thereof:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by the fifth section of the Fisheries Act, 1908, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the hereinbefore-recited regulations, and doth hereby make the following regulation in lieu thereof.


REGULATION.

  1. It shall be unlawful to use a set-net for taking fish in any portion of the Wanganui River, or to use a net of any description whatever for taking fish in that portion of the said river above a point three miles up the river from the Aramoho Railway Bridge. Such point shall be marked by a white post on each bank of the said river, having the words “Netting limit” painted thereon: Provided that this regulation shall not apply to nets allowed by any regulation for the time being in force to be used for taking whitebait in the said river.

IT is hereby notified that His Excellency the Governor-General has, in pursuance of the provisions of the Fisheries Act, 1908, and of the Official Appointments and Documents Act, 1919, appointed

John Hutton Grigg, of Longbeach,
John Montgomery, of Eiffelton,
George Apiti Read, of Eiffelton,
Samuel Priestly Taylor, of Eiffelton, and
Jack Cocks, of Eiffelton,

to be officers for the purposes of Part II of the first-mentioned Act, in respect of the Ashburton Acclimatization District.

Probationary Sub-Lieutenant Colin Lindsay as Sub-Lieutenant, R.N.V.R. (N.Z.D.); to date 24th March, 1930.

Probationary Sub-Lieutenant John Henry Seelye as Sub-Lieutenant, R.N.V.R. (N.Z.D.); to date 24th March, 1930.

HIS Excellency the Governor-General has been pleased to appoint in terms of subsection (7) of section 2 of the Meat-export Control Act, 1921–22,

James Begg, Esquire,

to be a representative of the producers of meat for export on the New Zealand Meat Producers’ Board established under the said Act, vice the Hon. Adam Hamilton, M.P., resigned.
