The Samoa Notaries Order, 1931.

ORDER IN COUNCIL.

At the Government House at Wellington, this 13th day of July, 1931.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

HIS Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of that Dominion, and in pursuance of the authority to make regulations for the peace, order, and good government of Samoa conferred upon him by the Samoa Act, 1921, and of all other powers and authorities enabling him in that behalf, doth hereby make the following regulations.

REGULATIONS.

SHORT TITLE.

  1. THIS Order may be cited as the Samoa Notaries Order, 1931.

APPOINTMENT OF NOTARIES PUBLIC.

  1. It shall be lawful for the Governor-General by Letters Patent under his hand and the Seal of New Zealand, in the form set out in the First Schedule hereto, from time to time, for the due convenience and accommodation of the public, to appoint fit persons to be Notaries Public in the Territory of Western Samoa.

RIGHTS AND DUTIES OF NOTARIES PUBLIC.

  1. Any person so appointed shall enjoy the like rights and privileges and be liable to discharge the same duties as Notaries Public are by custom, law, and usage wont to enjoy and discharge in New Zealand.

APPOINTMENT WITHIN SAMOA ONLY.

  1. No such appointment shall authorize the holder thereof to practise as a Notary in any place outside the Territory of Western Samoa.

APPLICATION FOR APPOINTMENT.

  1. No such appointment shall be made except upon the recommendation of the Administrator of Western Samoa, and upon the written application of the person seeking appointment supported by at least one Notary Public (whether practising in Western Samoa or elsewhere) within or outside the British Dominions, and upon satisfactory evidence of the character, integrity, ability, and competency of the applicant.

OATH.

  1. No such Letters Patent shall be delivered to the applicant until he has taken before the Administrator an oath of office in the form set out in the Second Schedule hereto, or made before the Administrator an affirmation in lieu of oath to the like effect, and until the Administrator has endorsed the Letters Patent with a statement signed by him that such oath has been taken or affirmation made, and the name of the Notary entered on the Roll of Notaries accordingly.

FEES.

  1. No such Letters Patent shall be issued until the applicant has paid to the Samoan Treasury a fee of £15 15s.

ROLL.

  1. The Administrator shall cause a Roll of Notaries to be kept and entry to be made therein of the name of every person to whom Letters Patent have been granted under this Order, the date of such Letters, the date of the delivery thereof, and the date of the death of every such person or other cause of his ceasing to be a Notary.
