The North-western Side of Portion of Springhill Road, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 16th day of March, 1931.

Present:

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anyway enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the eighteenth day of February, one thousand nine hundred and thirty-one, viz.:—

“ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to portion of the north-western side of Springhill Road in the said City of Dunedin where such portion of street abuts on Lot 7 and part Lot 6, Deeds Plan 221, being part of the Glen Estate, as the said portion of street is more particularly shown on the plan annexed hereto, and is thereon coloured brown and edged with red to its centre-line”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portion of Springhill Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE north-western side of all that portion of street, situated in the Otago Land District, City of Dunedin, known as Springhill Road, fronting part Lot 6 and Lot 7, Deeds Plan 221, being part of the Glen Estate. As the said portion of street is more particularly delineated on the plan marked P.W.D. 81229, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured brown and edged red.

the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waitaki County Council on the twenty-sixth day of July, one thousand nine hundred and twenty-nine, viz.:—

“ That the Waitaki County Council, being the local authority having control of the roads within the County of Waitaki, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the road fronting that part of Section 14, Block 7, Awamoko Survey District, shown on a survey plan by J. H. Treseder, dated the sixth day of April, one thousand nine hundred and twenty-nine ”; subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portion of road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.

SCHEDULE.

THE north-western side of all that portion of road in the Otago Land District, County of Waitaki, fronting part Section 14, Block VII, Awamoko Survey District. As the said portion of road is more particularly delineated on the plan marked P.W.D. 81231, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The North-eastern Side of Portion of Matauhi Road and the North-western Side of Portion of an unnamed Road in the Bay of Islands County (Russell Town District) exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

“The Bay of Islands County Council, being the local authority having control of the roads and streets in the Bay of Islands County, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-eastern side of portion of Matauhi Road fronting Lot 1 on a plan deposited in the Land Registry Office at Auckland under Number 21638, being part of Lot 3 of Section 14 of the Town of Russell, and to the north-western side of portion of an unnamed road fronting Lots 1 and 2 on the plan deposited as aforesaid under Number 21638, and being part of Lot 3 of Section 14 of the Town of Russell” ; subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of Matauhi Road (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of road.

SCHEDULE.

THE north-eastern side of all that portion of road situated in the North Auckland Land District, Bay of Islands County (Russell Town District), known as Matauhi Road, fronting Lot 1, D.P. 21638, being part of Lot 3 of Section 14, Town of Russell.

Also the north-western side of all that portion of unnamed road in the said land district and county fronting Lots 1 and 2, D.P. 21638, being part of Lot 3 of Section 14, Town of Russell.

As the said portions of roads are more particularly delineated on the plan marked P.W.D. 80724, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
