ORDER IN COUNCIL.
At the Government House at Wellington, this 16th day of February, 1931.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the New Plymouth Borough Council on the second day of February, one thousand nine hundred and thirty-one, viz. :
“ That the New Plymouth Borough Council, being the local authority having control of the street hereinafter mentioned, hereby resolves and declares that the provisions of section one hundred and twenty-eight, subsection one, of the Public Works Act, 1928, shall not apply to that portion of the southern side of Gill Street to which Section 1390 and part Section 1389, New Plymouth, have frontages ” ;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Gill Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.
THE southern side of all that portion of street situated in the Taranaki Land District, Borough of New Plymouth, known as Gill Street, fronting part Section 1389 and Section 1390, Town of New Plymouth. As the said portion of street is more particularly delineated on the plan marked P.W.D. 81065, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured yellow.

The North-eastern Side of Cemetery Road and the Northern Side of Portion of Gardner’s Valley Road, in the County of Waimea, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waimea County Council on the eighth day of January, one thousand nine hundred and thirty-one, viz. :
“ That the Waimea County Council, being the local authority having control of the roads within the Waimea County, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-eastern side of Cemetery Road, fronting Lot 1 and part of Lot 2 of part Section 1, Block XVI, Motueka Survey District, nor to the northern side of Gardner’s Valley Road, fronting Lot 3 and part of Lot 2, Block XVI, Motueka Survey District ” ;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of Cemetery Road or the northern side of portion of Gardner’s Valley Road (described in the Schedule hereto), within a distance of thirty-three feet from the centre-lines of the said portions of roads.

THE north-eastern side of all that road, situated in the Nelson Land District, County of Waimea, known as Cemetery Road, fronting part Section 1, Moutere District, Block XVI, Motueka Survey District.
Also the northern side of all that portion of road, in the said land district and county, known as Gardner’s Valley Road, fronting part Section 1, Moutere District, Block XVI, Motueka Survey District.
As the said portions of roads are more particularly delineated on the plan marked P.W.D. 80936, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the twenty-first day of January, one thousand nine hundred and thirty-one, viz. :
“ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the undermentioned portions of streets in the said City of Dunedin, viz.—
“ (a) Portion of the south-western side of McGregor Street abutting on Lot 40, Township of Maybank ; and
“ (b) Portion of the south-eastern side of Botting Street abutting on Lots 40 and 41, Township of Maybank ;
as the said portions of streets are more particularly shown on the plan annexed hereto and are thereon coloured brown and edged with red to their centre-lines ” ;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of the portion of McGregor Street or the south-eastern side of the portion of Botting Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.
