The Southern Side of Portion of a Road in the County of Southland, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 28th day of July, 1930.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Southland County Council on the twenty-seventh day of June, one thousand nine hundred and thirty, viz. :—

“ That this Council, being the local authority having control of the roads in the Chatton Survey District, hereby decides that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the portion of road adjoining Sections 10 and 11, Block VI, Chatton District ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of road (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of road.

SCHEDULE.

THE southern side of all that portion of road situated in the Southland Land District, County of Southland, fronting Sections 10 and 11, Block VI, Chatton District. As the said portion of road is more particularly delineated on the plan marked P.W.D. 79209, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The North-western Side of Portion of Signal Hill Road and the South-western Side of Portion of McGregor Street, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the ninth day of July, one thousand nine hundred and thirty, viz. :—

“ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the undermentioned portions of streets in the said City of Dunedin, viz :—

(a) Portion of the north-western side of Signal Hill Road abutting on Lots 36 and 37, Township of Maybank ; and

(b) Portion of the south-western side of McGregor Street abutting on Lot 37, Township of Maybank ;

as the said portions of streets are more particularly shown on the plan annexed hereto and are thereon coloured red to their centre-lines ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portion of Signal Hill Road or the south-western side of the portion of McGregor Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-lines of the said portions of streets.

SCHEDULE.

THE north-western side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Signal Hill Road, fronting Lots 36 and 37, Township of Maybank.

Also the south-western side of all that portion of street situated in the said land district and city, known as McGregor Street, fronting Lot 37, Township of Maybank.

As the said portions of streets are more particularly delineated on the plan marked P.W.D. 79338, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Withdrawing Land from the Operation of the Kauri-gum Industry Act, 1908.

ORDER IN COUNCIL.

At the Government House at Wellington, this 28th day of July, 1930.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by section one hundred and sixty-two of the Land Act, 1924, it is enacted that the Governor-General may, by Order in Council gazetted, on the recommendation of the Land Board, declare that any land comprised in a kauri-gum reserve shall, from a date to be specified in the Order, cease to be subject to the Kauri-gum Industry Act, 1908, and on and after the date so specified the land to which the Order relates shall become subject to the provisions of the Land Act, 1924 :

And whereas the Land Board of the North Auckland Land District has duly passed a resolution recommending that the Kaiwaka Kauri-gum Reserve, as described in the Schedule hereto, be excepted from the operations of the Kauri-gum Industry Act, 1908, and it is expedient to give effect to such recommendation :

Now, therefore, I, Charles, Baron Bledisloe, Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon me by section one hundred and sixty-two of the Land Act, 1924, and acting by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the Kaiwaka Kauri-gum Reserve, as described in the Schedule hereto, shall, from the sixteenth day of August, one thousand nine hundred and thirty, cease to be subject to the Kauri-gum Industry Act, 1908.

SCHEDULE.

ALL that area in the North Auckland Land District, Otamatea County, containing by admeasurement 168 acres 0 roods 27 perches, more or less, being Allotment 29 and the north-eastern portion of Allotment 30, both of the Parish of Kaiwaka, and being the Kaiwaka Kauri-gum Reserve, as described in New Zealand Gazette, 1899, No. 60, page 1303. As the same is more particularly delineated on the plan marked L. and S. 9/2411, deposited in the Head Office, Department of Lands Survey, at Wellington, and thereon bordered red. PURSUANT to the authority vested in me by section sixty-five of the Cook Islands Act, 1915, and by an Order in Council of the twenty-first day of March, one thousand nine hundred and sixteen, establishing (inter alia) an Island Council for the Island of Manihiki, in the Cook Islands, and determining the constitution thereof, I, Charles, Baron Bledisloe, Governor-General of the Dominion of New Zealand, do hereby nominate and appoint

Mehau Boaza,

of Manihiki, to be a member of the said Island Council of Manihiki, in lieu of Turuta (deceased), to hold office during my pleasure as from the date hereof.

As witness the hand of His Excellency the Governor-General, this 28th day of July, 1930.
