Revocation of Order in Council prohibiting all Alienation of certain Native Land other than Alienation in favour of the Crown.

ORDER IN COUNCIL.
At the Government House at Wellington, this 28th day of July, 1930.
Present :
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by section three hundred and sixty-three of the Native Land Act, 1909, it is enacted that any Order in Council made under that section may at any time be varied or revoked :
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority hereinbefore mentioned, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the Order in Council referred to in the Schedule hereto.

SCHEDULE.
ORDER IN COUNCIL under section 363 of the Native Land Act, 1909, dated the 11th day of March, 1930, and published in the New Zealand Gazette of 13th day of March, 1930, affecting Rangitoto-Tuhua 77B 1A and other subdivisions.

Revoking Order in Council licensing John Henry Colwill to use and occupy Part of the Foreshore and Land below Low-water Mark of Taikata Creek, Auckland Harbour, as a Site for a Wharf.

At the Government House at Wellington, this 28th day of July, 1930.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by Order in Council dated the seventh day of November, one thousand nine hundred and twenty-three, and published in the New Zealand Gazette, No. 82, of the twenty-second day of the same month, John Henry Colwill (who, with his executors, administrators, and assigns is hereinafter called “the licensee”), was licensed to use and occupy part of the foreshore and land below low-water mark of Taikata Creek, Auckland Harbour, as a site for a wharf :
And whereas the licensee has applied to have the hereinbefore-recited license revoked, and it is desirable to revoke the same :
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the Harbours Act, 1923, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the hereinbefore-recited Order in Council of the seventh day of November, one thousand nine hundred and twenty-three, as from the thirty-first day of March, one thousand nine hundred and thirty.

The Southern Side of Portion of Octavius Place, in the Borough of New Plymouth, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 28th day of July, 1930.
Present :
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in any-wise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the New Plymouth Borough Council on the second day of June, one thousand nine hundred and thirty, viz :—
“That the New Plymouth Borough Council, being the local authority having control of the street hereinafter mentioned, hereby resolves and declares that the provisions of section one hundred and twenty-eight, subsection one, of the Public Works Act, 1928, shall not apply to that portion of the southern side of Octavius Place to which part Section 1286, New Plymouth, has frontage ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Octavius Place (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.
THE southern side of all that portion of street situated in the Taranaki Land District, Borough of New Plymouth, known as Octavius Place, fronting part Section 1286, Town of New Plymouth. As the said portion of street is more particularly delineated on the plan marked P.W.D. 79299, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured yellow.

The South-eastern Side of Portion of Harbour Terrace, and the North-western Side of Portion of Bay View Terrace, in the Borough of West Harbour, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 28th day of July, 1930.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in any-wise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the West Harbour Borough Council on the first day of July, one thousand nine hundred and thirty, viz. :—
“That the West Harbour Borough Council, being the local authority having control of the streets in the West Harbour Borough, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to portions of the south-eastern side of Harbour Terrace, and the north-western side of Bay View Terrace, in the said West Harbour Borough, where such portions of streets abut on Allotment 39, Block I, Township of Ravensbourne, being also part of Section 41, Upper Harbour West District, as the said portions of streets are more particularly shown on the plan annexed hereto, and are thereon coloured brown and edged with red to the centre-line ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Harbour Terrace or the north-western side of the portion of Bay View Terrace (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portions of streets.

SCHEDULE.
THE south-eastern side of all that portion of street situated in the Otago Land District, Borough of West Harbour, known as Harbour Terrace, fronting Allotment 39, Block I, Township of Ravensbourne, being part Section 41, Upper Harbour West District.
Also the north-western side of all that portion of street situated in the said land district and borough known as Bay View Terrace fronting Allotment 39, Block I, Township of Ravensbourne, being part Section 41, Upper Harbour West District.
As the same are more particularly delineated on the plan marked P.W.D. 79277, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured brown and edged red.
