The North-western Side of Portion of Elgin Road, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 7th day of April, 1930.

Present:

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in any-wise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the twelfth day of February, one thousand nine hundred and thirty, viz.:-

"That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to portion of the north-western side of Elgin Road, in the said City of Dunedin, where such portion of street abuts on Allotment I, Block I, Township of Balaclava, being also part of Section 56, Block VI, Town District, as the said portion of street is shown on the plan annexed hereto, and is thereon coloured brown and edged with red to its centre-line";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portion of Elgin Road (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE north-western side of all that portion of street, situated in the Otago Land District, City of Dunedin, known as Elgin Road, adjoining Allotment I, Block I, Township of Bala-clava, being also part of Section 56, Block VI, Town District. As the said portion of street is more particularly delineated on the plan marked P.W.D. 77969, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured brown and edged red.

R. 31, Town of Greymouth ; (b) the portion of the southern side of Sheedy Lane fronting Sections 49 and 51, Block 2, N. R. 31, Town of Greymouth ; (c) the portion of the western side of Card Lane fronting Section 51, Block 2, N. R. 31, Town of Greymouth " ;

such portions of streets being described in the Schedule hereto.

THE eastern side of all that portion of street situated in the Westland Land District, Borough of Greymouth, known as Hallenstein Lane, fronting Section 49, Block 2, N. R. 31, Town of Greymouth.

Also the southern side of all that portion of street in the said land district and borough known as Sheedy Lane, fronting Sections 49 and 51, Block 2, N. R. 31, Town of Greymouth.

Also the western side of all that street in the said land district and borough known as Card Lane, fronting Section 51, Block 2, N. R. 31, Town of Greymouth.

As the said portions of streets are more particularly delineated on the plan marked P.W.D. 77538, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured blue.

"That the St. Kilda Borough Council, being the local authority having control of the streets of the Borough of St. Kilda, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Victoria Road and Bridgman Street fronting part Allotment 6, Block 31, St. Kilda";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of the portion of Victoria Road or the western side of the portion of Bridgman Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.

SCHEDULE.

THE northern side of all that portion of street situated in the Otago Land District, Borough of St. Kilda, known as Victoria Road, fronting part Allotment 6, Block XXXI, Township of St. Kilda.

Also the western side of all that portion of street in the said land district and borough known as Bridgman Street, fronting portion of Allotment 6, Block XXXI, Township of St. Kilda.

As the said portions of streets are more particularly delineated on the plan marked P.W.D. 77913, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured pink.
