IN pursuance and exercise of the powers and authorities conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken for the purposes of the milk-supply of the City of Wellington.

Appointing Members of the First and Second Divisions of the Court of Appeal.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 11th day of February, 1929.

THE RIGHT HONOURABLE SIR J. G. WARD, PRESIDING IN COUNCIL.

WHEREAS by section five of the Judicature Amendment Act, 1913, it is enacted that the Court of Appeal shall consist of two divisions, to be called respectively the First Division and the Second Division of the Court of Appeal; and that each division shall consist of five Judges of the Supreme Court, to be appointed to that division by the Governor-General in Council:

And whereas the power conferred by the said Act upon the Governor-General in Council of appointing Judges as members of either division, or of revoking any such appointment, shall be exercisable on the recommendation of not less than three Judges of the Supreme Court (of whom the Chief Justice shall be one), and not otherwise:

And whereas the Honourable Chief Justice, the Honourable Mr. Justice MacGregor, and the Honourable Mr. Justice Smith have recommended that the two divisions of the Court of Appeal for the year one thousand nine hundred and twenty-nine shall be constituted as shown hereafter:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in exercise of the powers conferred by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion doth hereby appoint

Opening Land in Hawke’s Bay Land District for Selection on Renewable Lease.

IN pursuance and exercise of the powers and authorities conferred on me by the Land Act, 1924, I, General Sir Charles Fergusson, Baronet, Governor-General of the Dominion of New Zealand, do hereby declare that the land described in the Schedule hereto shall be open for selection on renewable lease on Monday, the eighteenth day of March, one thousand nine hundred and twenty-nine, at the rental mentioned in the said Schedule; and I do also declare that the said land shall be leased under and subject to the provisions of the said Act.

SCHEDULE.

HAWKE’S BAY LAND DISTRICT.—THIRD-CLASS LAND.

Wairoa County.—Maungaharuru Survey District.

(Exempt from payment of Rent for Five Years.)

SECTION 5, Block IV: Area, 3,715 acres 1 rood 10 perches. Capital value, £1,400. Half-yearly rent, £28.

This block is situated in the Hawke’s Bay Land District, about forty-one miles due North of Napier. It is served by good access road—on its eastern boundary by Matahura and Heays Road and on the west within 6 chains of the boundary by the Pohukura–Tutira Road, both roads junctioning with the Napier–Wairoa Road, and about 10 miles from Tutira Railway-station.

The block is in a very rough state, and is covered with a dense growth of fern, stunted manuka, and tutu, with a considerable amount of light bush. There is very little pasture excepting a basin of about 100 acres of native grass, mixed with fern. The soil is of a pumiceous nature. The block generally is intersected by high ridges and deep ravines. Well watered, with an altitude up to 2,979 ft.

As witness the hand of His Excellency the Governor-General, this 9th day of February, 1929.

Changing the Purpose of a Reserve in the Westland Land District.

WHEREAS the land described in the Schedule hereto has been duly set apart as a reserve for a resting-place for travelling stock, being a purpose within Class II of the Second Schedule of the Public Reserves and Domains Act, 1908:

And whereas it is expedient that such land should be appropriated for recreation purposes, being a purpose within Class III of the said Second Schedule:

Now, therefore, I, General Sir Charles Fergusson, Baronet, Governor-General of the Dominion of New Zealand, in exercise of the powers and authorities conferred upon me by the eleventh section of the Public Reserves and Domains Act, 1908, do by this notification declare that the said land shall, from and after the first day of February, one thousand nine hundred and twenty-nine, be appropriated for recreation purposes under Class III of the Public Reserves and Domains Act, 1908; and I do hereby direct that this notification shall be published in the New Zealand Gazette.

RESERVE No. 1500, Block I, Punakaiki Survey District: Area, 6 acres 2 roods 6 perches, more or less.
