The North-eastern Side of Portion of Moeller Street, in the City of Wellington, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government Buildings, at Wellington, this 18th day of March, 1929.
Present:
THE RIGHT HONOURABLE SIR J. G. WARD, PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wellington City Council on the thirteenth day of December, one thousand nine hundred and twenty-eight, viz.:
“The Wellington City Council, being the local authority having control of the streets in the City of Wellington, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that part of the north-eastern side of Moeller Street, fronting Lot 34, D.P. 123 ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of Moeller Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE.
THE north-eastern side of all that portion of street, situated in the Wellington Land District, City of Wellington, known as Moeller Street, fronting Lot 34, D.P. 123. As the said portion of street is more particularly delineated on the plan marked P.W.D. 74697, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The Southern Side of Portions of Avalon Street, in the City of Christchurch, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Christchurch City Council on the nineteenth day of November, one thousand nine hundred and twenty-eight, in so far as it affects the portions of street described in the Schedule hereto, viz.:
“The Christchurch City Council, having control of Avalon Street, in the City of Christchurch, hereby by resolution declares that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to that portion of the south side of the said street lying between the western boundary of Lot 9, deposit plan 4218, and the western boundary of Lot 1, deposit plan 5054 ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of portions of Avalon Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portions of street.
SCHEDULE.
THE southern side of the portions of Avalon Street in the Canterbury Land District, City of Christchurch, fronting R.S. 41, and coloured red on the plan marked P.W.D. 74105 deposited in the office of the Minister of Public Works at Wellington.

Amending an Order in Council authorizing the Hikurangi Town Board to erect Electric Lines in the Hikurangi Town District and Portion of the Whangarei County.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 18th day of March, 1929.
Present:
THE RIGHT HONOURABLE SIR J. G. WARD, PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers conferred on him by the Public Works Act, 1928, and of every other power enabling him in that behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend the Order in Council dated the twenty-fourth day of September, one thousand nine hundred and twenty-eight, and published in the New Zealand Gazette, No. 71, of the twenty-seventh day of September, one thousand nine hundred and twenty-eight, authorizing the Hikurangi Town Board to erect electric lines in the Hikurangi Town District and portion of the Whangarei County by adding thereto the following clause:
“11. POSITION UPON CONSTITUTION OF AN ELECTRIC-POWER BOARD.
“An Electric-power Board duly constituted in terms of the Electric-power Boards Act, 1925, or any Act passed in amendment thereof or substitution therefor, shall, if its district includes the said area of supply, have the right at any time after the 31st day of March, 1934, and during the currency of this license to purchase and take over the licensee’s installation in the said area of supply at a valuation to be agreed upon between the said Board and the licensee, and failing such agreement, at a valuation to be fixed by a single arbitrator to be appointed pursuant to the provisions of the Arbitration Act, 1908, and thereupon the Governor-General may by Order in Council revoke this license. Furthermore, if an Electric-power Board constituted as aforesaid is duly authorized to erect electric lines within the said area of supply thereupon the Governor-General may, after the 31st day of March, 1934, by Order in Council revoke this license.”

IN pursuance and exercise of the powers and authorities conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken for the purposes of a technical school.
SCHEDULE.
APPROXIMATE area of the piece of land permitted to be taken: 1 rood 34·1 perches.
Being Lot 7 of L.T.P. 42, Section 25, and part Section 24.
Situated in Block XIII, Town of Dunedin (City of Dunedin). In the Otago Land District; as the same is more particularly delineated on the plan marked P.W.D. 74365, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.
