Authorizing the Laying-off of a Street in the City of Wellington
of a Width less than 66 ft. but not less than 40 ft., subject to
Conditions as to the Building-line.

At the Government House at Wellington, this 30th day of
November, 1928.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers vested in him by the
Municipal Corporations Act, 1920, the Public Works
Amendment Act, 1928, and of all other powers in anywise
enabling him in this behalf, His Excellency the Governor-
General of the Dominion of New Zealand, acting by and with
the advice and consent of the Executive Council of the said
Dominion, doth hereby authorize the Wellington City Council
to permit the laying-off of the proposed street described in the
Schedule hereto of a width less than sixty-six feet but not less
than forty feet, subject to the conditions that no building or
part of a building shall at any time be erected on the land
fronting Lots 5 to 24 (inclusive) of a subdivision of land shown
on D.P. 4002 within a distance of thirty-three feet from the
centre-line of the said street, nor on Lots 2, 3, 26, and 27 of the
said subdivision within a distance of five feet from the boundary
of the said street.
SCHEDULE.
THAT proposed street in the Wellington Land District, City of
Wellington, containing by admeasurement 2 roods 38 perches,
more or less, being part Section 36, Karori R.D. As the same
is more particularly delineated on the plan marked P.W.D.
71043, deposited in the office of the Minister of Public Works at
Wellington, and thereon coloured red.

ORDER IN COUNCIL.
At the Government House at Wellington, this 30th day of
November, 1928.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS in pursuance of section one hundred and
thirty-two of the Municipal Corporations Act, 1920,
a petition was presented to the Governor-General praying
that a certain area be excluded from the County of Levels
and included in the Borough of Timaru:
And whereas a Commission appointed under the said section
held inquiries and recommended that certain alterations be
made:
And whereas it is deemed expedient to make the alterations
of the boundaries of the said borough and of the said county
recommended by the said Commission:
Now, therefore, in pursuance and exercise of the powers
and authorities vested in him by the said Municipal Corpora-
tions Act, 1920, and of all other powers and authorities
enabling him in that behalf, His Excellency the Governor-
General of the Dominion of New Zealand, acting by and with
the advice and consent of the Executive Council of the said
Dominion, doth hereby declare that as on and from the first
day of April, one thousand nine hundred and twenty-nine
the area described in the Schedule hereto shall be excluded
from the County of Levels and included in the Borough of
Timaru.

the same commencing at a point on the Timaru Borough
boundary on the road forming the north boundary of
Redruth Township, and being the north-east corner of Lot
60 of the said township; thence along the east boundary of the
said lot, along the south boundaries of the said Lot 60 and
Lot 59, along the east and south boundaries of Lot 66, across
Rothwell Street in line with the east side of Simmons
Street, along the north boundary of part Lot 76, Lots 108
and 77, along the east boundary of Lot 78, along the south
boundary of Lot 77 to the north-east corner of the land in
Certificate of Title, Vol. 292, folio 217; thence along the south-
east boundary of the land in the said certificate of title to
and across Shaw Street; thence along the south-west side of
the said street to the north-east corner of Lot 106; thence
along the south-east boundary of that lot to a point in line
with the south-west boundaries of Lots 92, 91, and 90;
thence along that line to the south corner of Lot 92; thence
along the south-east side of Lots 93, 94, 95, 96, 97, 98, 99,
100, 101, 102, 103, 104, to the Saltwater Stream forming the
south-west boundaries of Lot 104, Rothwell Street, Lots 2,
1, and 46; thence along Saltwater Stream to the Main South
Road; thence along the north-west boundaries of Lots 46,
45, 44, 43, 42, and 41 to a point in line with the north-east
side of Lot 2, deposit plan Number 1128; thence along that
line, across the Main South Road to the Timaru Borough
boundary; thence north-easterly generally along the Timaru
Borough boundary to the point of commencement.

Closing Portion of Cemetery at Waitakerei.—(H. 2/113.)

ORDER IN COUNCIL.
At the Government House at Wellington, this 30th day of
November, 1928.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS it appears to the Governor-General that
burials in that portion of the cemetery at Waitakerei
in the Waitemata County, which is described in the Schedule
hereto, should be wholly discontinued:
And whereas a sufficient cemetery not within the limits
of any borough or town district has been provided, and has
been prepared for the interment of the dead as required by
the Cemeteries Act, 1908:
Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
and in pursuance and exercise of the powers and authorities
vested in him by the said Act, doth hereby order and direct
that from and after the first day of July, one thousand nine
hundred and twenty-nine, that portion of the Waitakerei
Cemetery in the Waitemata County, described in the Schedule
hereto, shall be closed and burials therein discontinued; and,
further, that the said portion of Waitakerei Cemetery shall,
from and after the said first day of July, one thousand nine
hundred and twenty-nine, be vested in the Mayor, Councillors,
and Citizens of the City of Auckland under the provisions and
for the purposes of section seventy-eight of the Cemeteries
Act, 1908.
SCHEDULE.
WAITAKEREI CEMETERY RESERVE—PART OF SECTION 112,
WAIPAREIRA PARISH.
ALL that area in the North Auckland Land District con-
taining by admeasurement two roods and twenty-eight
decimal five perches (2 roods 28·5 perches), more or less, being
portion of Section 112, Waipareira Parish, bounded as follows:
Commencing at a point on a public road, being the southern-
most corner of Section 112, Waipareira Parish, by the afore-
said public road, 170·6 links bearing 309° 35′ to the eastern-
most corner of portion Section 112 aforesaid, as described in
New Zealand Gazette, 1905, page 1455; thence on the west
by that portion of Section 112, 500·0 links bearing 353° 05′
to Peg 11A; thence on the north-east by another portion
Section 112, 568·0 links bearing 150° 06′ to the north-west
boundary of Lot 2 on D.P. 17236; thence by that boundary
145·1 links bearing 219° 03′ to the aforementioned public
road, the point of commencement: As the same is more
particularly delineated and edged blue on a plan marked
191/52, and deposited in the Head Office of the Depart-
ment of Health, Wellington.
